<br />79-- Ut;~~:~~ <br />that no insurer of. any interest or either shall have any right of subrogation <br />against the other and that any ar all fire and other insurance policies carried <br />by either on the leased premises or the fixtuzes and equipment therein shall <br />contain a full waiver of subrogation by the insurer against the other and its <br />assigns. "All risk coverage with an agreed value endorseaent to apply." <br />(b) Lessee's Fixtures; Lessee agrees that it will assume the risk of <br />damage to any fixtures installed by or at the expense of Lessee in the building. <br />17. Fublic Liability Insurance and Indemnity: (a) Lessee shall, at its <br />own cost and expense, keep and maintain in full force during the term hereof, <br />public liability insurance covering the leased premises and Lessee's activities <br />therein against claims for personal injury and death in amaunts of not less than <br />O:1E : w'*:L14.EL' TuOL'SA*:B DOLLARS ($100,000.00) for injury or death of any one person; <br />THREE HUNDRED THOUSAND DOLLARS {$300,000.00) for injury or death of all persons <br />in any one accident or occurrence, and TWENTY FIVE THOUSAND DOLLARS ($25.000.00) <br />property damage, Lessee shall furnish to Lessors a certificate evidencing the <br />fact that the insurance described herein has been obtained and is in full force <br />and effect; that Lessors are an additional insured thereunder, and that it <br />cannot be cancelled without ten day's prior notice to Lessors. <br />(b) Lessee covenants that it shalt hold and save Lessors harmless of and <br />from any and all loss, cost or damage arising by reason of injury or death <br />of persona or damage to property in or upon the leased premises or caused by <br />activities conducted thereon; provided, however, that Lessee shall noL be <br />required to indemnify Lessors for any damage or injury of any kind arising out <br />of the negligence of Lessors, its agents or employees. <br />18. Damage and Destruction:{a) In the even[ that the building or im- <br />provements on the leased premises are damaged or destroyed during the term of <br />this lease, Lessors shall, except as hereinafter provided, diligently repair or <br />rebuild the same to substantially the condition in which the same existed <br />immediately prior to such damage or destruction. <br />(b). Rent Abatement: Rental due and payable hereunder shall be abated <br />prapartionately during any period in whlch by reason of any such damage or <br />-3- <br />
