Term; The term of this Lease shall be twentq (20~ years, cammeaciag <br />upon completion of construction of the building and improvements to be con- <br />structed by the Lessor and delivery to Lessee of possession of such eompleted <br />building and improvements, and expiring oa the 20th anniversary of such <br />commencement date, unless sooner terminated pursuant to the terms and conditions <br />contained herein. LTpon notification of completion of the hui131ng and Im- <br />provements by the Lessor to the Lessee, and upon inspection of the building <br />and improvements by Lessee, and acceptance thereof by Lessee, Lessor and Lessee <br />shall execute promptly a written confirmation of the date of completion of the <br />building and improvements and acceptance thereof by Lessee, and a confirmation <br />of the date of commencement of the annual rental described herein. <br />4. Improvements: Lessors shall cause the building improvements and <br />equipment described in the plane and specifications heretofore approved by <br />Lessors, Lessee and Flory Mopp.~t's Day Care Schools, Inc. as shown by their <br />signatures thereon, to be constructed upon the above-described property at <br />Lessor's sole coat and expense. Said building and improvements shall be <br />substantially completed on or before April 15, 1979 , provided <br />that such date shall be extended for any delays in construction beyond the <br />reasonable control of Lesaora. Lessors shall obtain for the benefit of <br />Lessors and Lessee a written warranty from the contractor or contractors <br />performing the construction of the building and improvements that the contractor <br />shall repair or replace any defects in materials or workmanship appearing within <br />one year after substantial completion of construction provided that such <br />warranties provided by manufacturers or suppliers of equipment or materials <br />incorporated in the work or express warranties required by the plane and <br />apacificatians in addition to the foregoing, shall be obtained for the benefit <br />of Lessors and Lessee and jointly and severally. Upon notification of substantial <br />completion of the building and improvements by the Lessors to the Lessees, they <br />shall each execute promptly a written confirmation of the date of substantial <br />completion,T,he building and improvements to be constructed pursuant hereto <br />shall conform to all applicable governmental regulations. <br />-2- <br />
