Cnmplete Agreement: It is expressiy agreed that this Lease contains all <br />terms, tovenants, conditions, warranties and agreements of the parties relating <br />in any manner to the rental and use and occupancy of the leased premises and <br />that no prior agreements or understanding pertaining to the same shall be valid <br />or of any force or effect, and Chat terms, covenants, conditions and provisions <br />of this Lease cannot be altered, changed, modified or added to except in writing <br />, signed by the parties hereto. <br />28, Time is of the essence hereof. <br />24. Short-Form Lease: Upon request of ei.:~er Lessors or Lessee the parties <br />hereto will execute and acknowledge a short-form lease for purposes of recording, <br />which said short-form lease shall describe the property described in Exhibit "A" <br />as being subject to rights, covenants and restrictions contained herein. <br />30. Assignment and Subletting: Lessee shalt not have the right tQ assign or <br />sublet Lhe premises without first obtaining the written consent of Lessor to <br />such assignment or subletting. Lessor's consent shall not be unreasonably withheld. <br />In addition, should this Lease be unsured-under a policy of lease guarantee <br />insurance, Lessee must obtain the written consent of the insurer prior to any <br />such assignment of subletting. <br />31. Mortgage by Lessors: It is expressiy understood and agreed that Lessors <br />shall have the right at any time during the term of this Lease and From tip to <br />time to mortgage their interest in the leased premises, for any purposes, and <br />.that Lessee will, if requested by the lender, subordinate its interest in <br />-the leased premises to the lien of such mortgage provided such lender agrees Co <br />respecC this Lease Agreement and accept the performance by Lessee of its <br />covenants and obligations hereunder in the event such mortgage shall be foreclosed. <br />32. ACtorney's Fees: The Lessee shall pay and indemnify the landlord <br />against all iegai costs and charges, including counsel fees reasonably incurred, <br />in obtaining possession of the Leased premises after a default of the Lessee <br />default in surrendering possession upon the expiration or earlier termination <br />of the term of the i,ease or enforcing any covenant of the Lessee herein contained. <br />1N WITNESS WHEREOF, the parties hereto have executed this Lease as of the <br />_; day and year first above written. <br />` - 13 - <br />
