Setlik ar:d Dorot?:y M. Sorlik, h~,,gband and Wife, <br />and Clarence L. Shuda and Vernie K. Shuda, husband and wife, hereinafter called <br />the Subdividers, as owners of a tract of land comprising a part cf the West Half <br />of the Northeast Quarter {W3gNEl4), and part of the Northwest Quarter (NSr'~4), all in <br />Section Thirty Five {35), Township Eleven (ll) North, Range Ten (10} West of the <br />6th P.M. in Hall County, Nebraska, more particularly described in the plat of said <br />subdivision, and <br />WHEREAS, it is the desire of the aforesaid owners of said subdivision to <br />improve WESTROADS ESTATES 4th by encouraging the sale of lots and the construction <br />of modern and desireable dwellings. <br />NOW, THEREFORE, IN consideration thereof, and of the mutual benefits to be <br />derived by the owners of said subdivision, and any purchaser or purchasers, their <br />heirs, administrators, executors, successors and assigns, the owers stipulate and <br />agree that any and all lots in said subdivision sold, transferred and conveyed <br />shall be and are subject to the following Protective Covenants, Restrictions and <br />Conditions, all of which shall run with the land as follows: <br />1. A11 lots in the subdivision shall be known and described as resi- <br />dential lots. <br />- 2. Each lot mill have no more than one dwelling unit thereon and such <br />dwelling must meet the fallowing minimum square foot requirements: <br />"s (a) Each one-story dwelling, not less than one thousand two hundred <br />fifty (1,250) square feet of living space on ground level, exclu- <br />sive one-story open porches and attached garages. <br />(b) Fach one and one-half story or two story house shall have at <br />least 880 square feet on main floor excluding porches and garages. <br />3. No apartment house, duplex, or tri-plex shall be built on any lot <br />without the written consent of the subdivider, its successors or assigns, nor shall <br />t any basement house be built on any lot. <br />- 4. No structure shall be erected, altered, place or permitted to remain <br />}` on any lot other than one single-family dwelling, not to exceed two stories in <br />}{ height, and not less than a two-car garage or more than a three-car garage of the <br />~ sawe style, material sad quality of construction as the outside finish and roof of <br />
