~~ <br />and the City Council to be acknowledged by such cwner, certified as <br />to accuracy of survey by a registered land surveyor, and to contain <br />a dedication of the streets to the public for its use forever, and of <br />the easements to public !itilities. In consideration of the acceptance <br />of the plat of Lot 3, Block 9, Continental Gardens, the Subdivider <br />hereby consents and agrees with the City of Grand Island, ?~ebraska, <br />that it will install at its expense the following improvements: <br />1. Water. The property located in the subdivision may be <br />connected to the City water main located in Webb Road or Rue de College, <br />adjacent to the subdivision, with no connection fee. <br />2. Sanitary Sewer. Sanitary sewer is available in Rue de College <br />Street, and all structures located in the subdivision must be connected <br />to such sanitary sewer before the Subdivider will apply for an occupancy <br />permit for any such structure. There will be no connection fee. <br />3. Drainage. The Subdivider agrees to grade the subdivision <br />basically in accordance with the plans on file with the City's Director <br />of. Public Works for the drainage of Continental Gardens Subdivisions <br />prepared by Mits Kawamoto, and dated January 7, 1975, subject to the <br />final approval of the City's Director of Public Works as to their com- <br />pliance with such plans, and that such subdivision drains to the public <br />right-of-way. <br />4. Sidewalks. The Subdivider, if still the awner of the land in <br />the proposed subdivision, cr if the Subdivider shall have transferred <br />title to the property, ther, the various Grantees thereof, will install, <br />at their own expense, all public sidewalks required by the Grand Island <br />City Code when the adjacent tot is built upon, and sidewalks shall be <br />regulated and required with the building permit for eacl; such lot. <br />These sidewalks will be installed only when deemed necessary by the City <br />of Grand I sl and . <br />5. Warranty. The ur:dersigred Owner, as SUbdrvlder, warrants that <br />it is the owner in fee simple of the land described and proposed to be <br />known as Lot 3, Block 9, Continental Gardens, and that an abstract of <br />title will be submitted for examination, if necessary, upon request of <br />the City of Grand Island. <br />-2- <br />
