Sanitary Sewer. The Subdividers agree to petition for the <br />construction of sanitary se~:ex to serve all lots in *_he Subdivision <br />prior to requesting, any occupancy permit for any structure in said <br />subdivision, and agree to connect such structures to the City's sanitary <br />sewer. In the alternative, the Subdividers may construct a sanitary <br />sewer in accordance with plans and specifications approved by the City's <br />Director of Public ~~~orks and subject to the City's inspection. <br />4. Drainage. '~"~:e Subdividers agree to grade all lots of the <br />subdivision in conjunction with the structures thereon so that the <br />storm water drains to public right-of-way. Furthermore, the Subdividers <br />agree to construct the necessary storm sewer pipe to conduct storm <br />water flow from EZIen Lane under ground along Tcaelth Street to the <br />storm sewer main located in St. Paul Road. <br />5. Sidewalks. 'The Subdividers, if still the owners of the land <br />in the proposed subdivision, or if the Subdividers shall Nave transferred <br />title to the property, then the various grantees thereof, will install, <br />at their oFm expense, ail public sidewalks required by the Grand Island <br />Ci*_y Code when the adjacent lot is built upon, and sidewalks shall be <br />regulated and required with the building perc*,it fog each suc%~ lot. <br />6. Warranty. The undersigned ow.=ers, as Subdividers, warrant that <br />they are the owners in fee simple of the land described and proposed to <br />be known as Houghkirk Subdivision, and that an abstract of title will be <br />submitted for examination, if necessary, upon request of the City of <br />Grand Island. <br />7. This agreement shall run with the land and shall be binding <br />upon and inure to the benefit of the parties hereto, their successors, <br />assigns, heirs, devisees, and lega*_ees. <br />- 2 - <br />
