79-- ~ ~ 7~ <br />WHEREAS, t intend this document to be a disclaimer <br />under the provisions of the Internal Revenue Code, as now <br />existing or as hereinafter amended, see for example IRC <br />Sections 2518 and 2045; <br />WHEREAS, I intend this document to be a "renunciation <br />of succession" under the provisions of Nebraska law as now <br />existing or as hereinafter amended, see for example Neb.Rev.Stat. <br />Sectian 30-2352; <br />WHEREAS, I do not expect to, nor have I, controlled, <br />directed, or selected, the person or entity who shall receive, <br />possess, or enjoy, the interest or power hereby renounced <br />and disclaimed; <br />WHEREAS, I intend this document to constitute an irrevocable <br />disclaimer and renunciation, and in that regard I acknowledge <br />that I have relied upon certain assumptions regarding factual <br />matters which I realize may not be correct, but I assume <br />this risk and intend this document to be effective nevertheless; <br />WHEREAS, I have not accepted any interest in the foregoing <br />power or interest which is the subject of this renunciation <br />or disclaimer or any benefits therefrom, nor have I made any <br />transfer thereof, nor have I accepted any delivery of such <br />power or interest, nor have I exerted any dominion of any <br />kind over such power or interest, and no such power or <br />interest has been either sold or disposed of otherwise <br />pursuant to judicial process therefor; <br />RENONCIATIOid ANH DISCLAIMER <br />1. Incorporation ^f Recitals and Intrcduction. The <br />foregoing Introduction and Recitals are incorporated herein <br />and made a material part hereof. <br />2. Interest or Power Renounced and Disclaimed. <br />A. The power or interest I renounce and disclaim, <br />pursuant to and under the provisions of Neb. <br />Rev.Stat. Section 30-2352, and IRC Sections 2518 <br />and 2045, is as follos:s; <br />Any and all interest I have or may have, as a life <br />tenant, beneficiary of a testamentary trust, devisee <br />or otherwise in the property passing to me for my <br />life under Article III of the Last Will and Testament <br />of Beatty F. Douthit, deceased, dated May 5, 1976, <br />and admitted to probate in the Hall County Court, <br />Grand Island, Nebraska. Said property includes the <br />property itemized in Exhibit "A" attached hereto <br />and made a part hereof by this reference as though <br />fully set forth herein. <br />II. If my renunciation and disclaimer is in part, with <br />reference to specific parts, ar regarding fractional <br />shares, the extent of my renunciation and disclaimer <br />is described as follows: <br />1. The power or interest which I renounce and <br />disclaim is: Not applicable. <br />2.
