Lessee agrees to hold Lessor harmless <br />from any liability arising out of injury or death to persons and <br />damage to property occurring on the premises. <br />10. Lessee agrees not to encumber the premises or fixtures <br />located thereon or any growing craps without the prior consent of <br />Lessor; provided, that Lessor hereby consents to Lessee granting <br />financing statements to lenders for Lessee's share of the growing. <br />crops for annual operating expenses. Upon termination of the <br />Lease, lessee agrees to vacate the premises without any further <br />notice by Lessor to Lessee. <br />11. Participation of the leased premises in any offered <br />program of the United States Department of Agriculture for crop <br />production control, sail conservation or range improvement or for <br />any other governmental agricultural program, and the observation <br />of the terms and conditions of any program shall be at the option <br />of the Lessor and Lessee as they may agree upon with all <br />government payments to be made to the Lessor and Lessee, one-half <br />each. <br />12. Lessee shall be in default under this Farm Lease upon <br />the happening of any of the following events: <br />A. Default in the payment of any rent or in <br />the performance of any term, condition or <br />covenant to be performed by Lessee under <br />this Lease; <br />B. The execution of an assignment for the <br />benefit of creditors by Lessee if the <br />assignment prejudices any of Lessor's <br />rights and benefits under this Lease; <br />C. The commencement of any proceeding under <br />the Bankruptcy Laws by or against Lessee; and, <br />D. Abandonment of the premises by Lessee. <br />If Lessee is in default as defined above, lessor may terminate <br />this Lease by giving written notice of termination to Lessee; and <br />Lessor may regain possession of the premises in the manner <br />provided by the caws of the State of Nebraska.
