2oo9oss5~ <br />of loss under such policy, Beneficiary is authorized to adjust, called and <br />compromise all claims thereunder and shall have the option of applying ap or a <br />part of the insurance proceeds: {i) to any indebtedness secured hereby in such <br />order as the Beneficiary may determine, (ii} to the Trustors to be used far the <br />repair or restoration of the Praperty, or (iii) for any other purpose or object <br />appropriate under this Deed of Trust as detem~ined by the, Beneficiary without <br />affecting the lien of this Deed of Trust for the full amount secured hereby before <br />such payment occurred. Any application of proceeds to indebtedness'shail not <br />extend or postpone the due date of any payments under the Promissory Note, ar <br />cure any default under such Promissory Note or this Deed of Trust. At the <br />request of the Beneficiary, the Trustors shall famish to the Beneficiary a <br />Cert~cate of Insurance evidencing the stated coverage, showing the Beneficiary <br />as a loss payee, with a provision in such Certificate, that the insurer shall provide <br />at least ten (10} days advance written notice of any cancellation of the palicy at <br />any time, far any reason, or of the expiration of the palicy without renewal <br />thereof. <br />4. Environmental Compliance. The Trustors shall comply with all federal, state and <br />local environmental laws, ordinances, rules, requirements, regulations and <br />publications as now existing ar hereafter existing, amended, supplemented or <br />supplanted relating to the preservation of the environment or the regulation or <br />control of toxic nr hazardous substances ar materials. Trustors hereby warrant <br />and represent to the Beneficiary that there are no toxic ar hazardous substances <br />ar materials an or under the Property. Trustors do hereby agree to indemnify and <br />hold the Beneficiary harmless, together with its successors and assigns, from <br />', and against any and al[ claims, damages, losses and liabilities arising in <br />connection with the presence, use, disposal or transport of any substance which <br />is the subject of any environmental law, regulation or control of toxic or <br />hazardous substances or materials on, under, from, ar about the Property. This <br />indemnity shall survive reconveyance of the Praperty secured by this Deed of <br />Trust. <br />se_an_ _reservati <br />an of the Properly. The Trustors shall use the Property for <br />residential use and -~~ <br />y and for lawful purposes only. The Trustors shall not <br />substantially change the Properly, nor allow the Property to deteriorate, or <br />commit or permit waste. The Trustors shall comply with all laws and regulations <br />applicable to the use of the Property and shall maintain all improvements thereon <br />in goad working order and repair. <br />6. Protection of the Trust Prc~nerly. If the Trustors fai( to pay taxes or assessments, <br />maintain insurance or maintain the Property as provided herein, the Beneficiary <br />may pay any such amounts or take steps necessary to protect the value of the <br />Praperty and the rights of the Beneficiary in the Property. Any sums the <br />Beneficiary may advance for payment of any such taxes ar assessments, <br />maintenance and protection of the Praperty shall be secured by this Deed of <br />Trust, shall constitute a debt due from the Trustors to the Beneficiary, and shall <br />bear interest from the date of disbursement until paid at the rate of 1fi% per <br />annum- <br />7. A lication of Pa ants. All payments received by the Beneficiary under the <br />Promissory Note and this Deed of Trust shall be applied first to reimburse any <br />advancements made by the Beneficiary far the protection of the Properly, second <br />to interest, and the balance to principal. <br />8. Inspection. The Beneficiary, or the Beneficiary's agent, may make reasonable <br />entries on the Property for the purposes of inspection. <br />9. Forebearance Not Waiver. Failure by the Beneficiary to exercise any right or <br />remedy available under this Deed of Trust or the Promissory Note as to any one <br />(1) event of default, shop not waive or preclude the exercise of any right ar <br />
