<br />THIS DECLARATION OF EASEMENTS AND RESTRICTIONS is made this day
<br />of July 2009 by VILLAGE DEVELOPMENT -GRAND ISLAND, LLC, a Nebraska limited ~
<br />liability company ("Declarant").
<br />RECITALS
<br />WHEREAS, Declarant is the owner of the real property legally described as follows
<br />("Lot 1 "):
<br />Lot One (1), Meadowlark West 6th Subdivision, in the City of Grand Island, Hall
<br />County, Nebraska; and
<br />WHEREAS, Declarant is the owner of the real property legally described as follows
<br />("Lot 2"):
<br />Lot Two (2), Meadowlark West 6th Subdivision, in the City of Grand Island, Hall
<br />County, Nebraska; and
<br />WHEREAS, Declarant desires to impose certain easements upon Lot I, and to establish
<br />certain covenants and restrictions with respect to Lot 1, on the terms and conditions hereinafter set
<br />forth.
<br />NOW, THEREI~ORE, in consideration of the above premises and of the covenants herein
<br />contained, Declarant daes hereby declare that Lot 1 and all present and future owners and
<br />occupants thereof, or any portion thereof, shall be and hereby are subject to the terms, covenants,
<br />easements, restrictions and conditions hereinafter set forth in this Declaration, so that Lot 1 shall
<br />be maintained, kept, sold and used in full compliance with and subject to this Declaration and, in
<br />connection therewith, Declarant covenants and agrees as follows:
<br />1. Grant of Easements. Subject to any express conditions, limitations or reservations
<br />contained herein, Declarant hereby grants, establishes, covenants and agrees that Lot 1
<br />and Lot 2 shall be benefited and burdened by the following perpetual easements which
<br />are hereby imposed upon Lot 1 and all present and future owner of Lot 1:
<br />a. Utility Easement. An easement under and across Lot 1 for the installation,
<br />maintenance, repair and replacement of water mains, storm drains, sewers, water
<br />sprinkler system lines, telephone or electrical conduits or systems, cable, gas
