200501432 <br />the failure of the existing private well source, whichever event shall first occur, the Subdividers, <br />their heirs and successors, agree to pay those costs for installation and extension of water lines <br />from the Village of Alda public water service necessary to connect all lots in the subdivision in <br />accordance with plans and specifications approved by the Village Engineer and subject to <br />inspection by the Village; and further agrees to then connect all structures intended for occu- <br />pancy in the subdivision to said water. <br />4. Sanitary Sewer. Public sanitary sewer service is available to the subdivision; <br />however, until such time as the subdivision shall be further subdivided to facilitate commercial <br />or residential development, or in any manner additional construction of residential or commercial <br />structures upon portions of the real estate within the subdivision shall occur, the Subdividers, <br />their successors and assigns shall be permitted to continue using the existing private septic <br />system. In the event that additional subdivision or construction of residential or commercial <br />structures upon portions of the real estate within the subdivision shall occur, or upon the failure <br />of the existing private well source, whichever event shall first occur, the Subdividers, their heirs <br />and successors, agree to pay those costs for installation and extension of sewer lines from the <br />Village of Alda public sewer line necessary to connect all lots in the subdivision in accordance <br />with plans and specifications approved by the Village Engineer, and subject to inspection by the <br />Village; and further agree to then connect all structures intended for occupancy in the <br />subdivision to said sanitary sewer service. <br />5. Drainage. The Subdividers agree to grade the lots of the subdivision in conjunction <br />with the structures thereon so that the storm water drains to the public right -of -way as approved <br />by the Village Engineer. <br />6. Engineering Data. All engineering plans and specifications for improvements shall be <br />furnished by the Subdividers to the Village Engineer for approval prior to contracting for con- <br />struction of any improvements. <br />7. Warranty of Title. The undersigned owners, as Subdividers, warrant that they are the <br />owners in fee simple of the land described and proposed to be known as PRAIRIELAND <br />SUBDIVISION, and that an abstract or report of title will be submitted for examination, if <br />necessary, upon request by the Village of Alda, Nebraska. <br />8. Perpetuity of Provisions. This agreement shall run with the land and shall be binding <br />upon, and shall inure to the benefit of, the parties hereto, their successors and assigns.
