200501143 <br />(c) No Occupant shall have an exterior sign which identifies leased departments <br />and /or concessionaires operating under the Occupant's business or trade name, nor shall <br />such sign identify specific brands or products for sale or services offered within a business <br />establishment, unless such identification is used as part of the Occupant's trade name; <br />provided, however, the foregoing restriction shall not apply to Anchor Occupants. <br />9.3 Sign Restrictions. <br />(a) No exterior identification signs shall be permitted within the Shopping Center <br />except as expressly permitted in this Article 9. <br />(b) No Occupant identification sign attached to the exterior of Building nor any <br />freestanding sign shall consist of: <br />(i) flashing, moving or audible signs except that in the case of a bank, <br />a moving sign that shows the Dow Jones Industrial Average, time and temperature, <br />and similar information customarily shown on first -class bank signs may be used <br />and except that in the case of a fuel center, a customary changeable sign to reflect <br />fluctuations of gasoline prices may be used; <br />(ii) signs employing exposed raceways, exposed neon tubes, exposed <br />ballast boxes, or exposed transformers; provided, however, exposed raceways shall <br />be permitted if (A) the primary purpose of the raceways are to limit damage to the <br />Buildings to which the raceways are attached and (B) the raceways do not draw <br />undue attention when viewed from the Common Area; or <br />(iii) paper or cardboard signs, temporary signs (exclusive of contractor <br />signs), stickers or decals; provided, however, the foregoing shall not prohibit (A) the <br />placement at the entrance of each Occupant's space of a small sticker or decal, <br />indicating hours of business, emergency telephone numbers, acceptance of credit <br />cards, and other similar information, or (B) with the prior approval of the Approving <br />Parties "For Sale" signs, "For Lease" signs, "Coming Soon" signs and "Grand <br />Opening" signs placed within the Shopping Center for a period of time not to exceed <br />ninety (90) days per instance. <br />(c) Notwithstanding anything contained herein to the contrary, each Party shall <br />be permitted to place the following signs within the Common Area located on its Tract: <br />(i) directional signs or informational signs such as "Handicapped <br />Parking "; <br />(ii) temporary signs displaying leasing information; and <br />(iii) one (1) temporary sign identifying each contractor working on a <br />construction job. <br />GALEGAL \STORES \NE\GRAND ISLAND \OEA4.WPD <br />11/16/04 28 <br />
