200501140 <br />1. Paving. The Owners/Subdivider agree to pave Wilmar Avenue and west <br />North Front Road in accordance with plans and specifications approved by the City's Director of <br />Public Works, and subject to the City's inspection. If the Owners/Subdivider fail to pave Wilmar <br />Avenue and West North Front Street, the City may create a paving district to perform such work. The <br />Owners/Subdivider agree to waive the right to object to the creation of any paving district for <br />Wilmar Avenue and West North Front Street where they abut the subdivision if they fail to pave <br />these streets as required herein. <br />The Owners/Subdivider agrees to waive the right to object to the creation of any <br />paving or repaving district for Old Potash Highway and Webb Road where it abuts the subdivision. <br />The Owners/Subdivider agrees to remove the existing concrete on that portion of the <br />existing Wilmar Street that will be vacated in conjunction with the development of Martin's Second <br />Subdivision. <br />2. Water. Public water is available to the subdivision and the <br />Owners/Subdivider agrees to extend, connect and provide water service to all lots in the subdivision <br />in accordance with plans and specifications approved by the Director of Public Works and the <br />Utilities Director, and subject to the City's inspection. <br />The Owners/Subdivider agrees to abandon the existing public water main in the right- <br />of-way of Wilmar Avenue that will be vacated for the development of Martin's Second Subdivision. <br />No water connection will be allowed in Martin's Second Subdivision until the final development <br />plans are approved by the City Utilities Department that will vacate the existing water service lines. <br />The new water system will not be accepted into the City's public water system until the existing <br />water system is appropriately abandoned and approved as such by the City Utilities Department <br />1102 <br />
