c. <br />d. <br />e. <br />f. <br />200500497 <br />Mechanical garage <br />equipment such as <br />related appliances <br />Private fences <br />door openers or any mechanical <br />air conditioning condensers, and <br />and equipment <br />Exterior decks <br />Pruning, removal or replacement of trees and shrubs <br />g. Replacement, repair and maintenance of roofs, <br />gutters and down spouts shall be the responsibility <br />of the individual homeowner. However, the <br />Association shall (thru the Architectural Committee) <br />approve the type, shape, and color etc. of material <br />and all other aspects of the replacement so that it <br />will remain complimentary to the remaining units. <br />In the event that the need for maintenance or repair is <br />caused through the willful or negligent act of the Owner, his <br />or her family, guest, or invitees, the cost of such <br />maintenance or repairs shall be added to and become a part of <br />the regular assessments to which such Lot is subject. <br />The Association is specifically authorized hereunder to <br />contract with any professional management company to furnish <br />professional management of the Properties, and to provide <br />said exterior maintenance as set forth herein. <br />The Association may, upon request from and with the written <br />consent of the individual lot owner, contract to have various <br />maintenance items performed for the benefit of the lot owner. <br />It is expressly understood that the Association will expect <br />prompt payment of fees for the service performed, and that <br />any liability resulting from the performance thereof shall be <br />solely the responsibility of the lot owner and not the <br />Association. <br />Section J. Maximum Annual Assessment, The Board of <br />Directors may fix the annual assessment at an amount not in <br />excess of the maximum. <br />a. Maximum annual assessment may be increased each year <br />not more than ten percent (100) above the maximum <br />assessment for the previous year without vote of the <br />membership <br />b. The maximum annual assessment may be increased above <br />ten percent (10 %) by two - thirds (2 /3rds) of members <br />who are voting in person or by proxy at a meeting <br />duly called for this purpose. <br />5 <br />
