CL] <br /> ~ ~'1 <br />~ ~ ~ <br />~ <br /> ~ Z <br />v <br />EASEMENT AGREEMENT <br />THIS EASEMENT AGREEMENT ("Agreement") is made and entered into the <br />day of May, 2009, by and between WARREN J. KIRSCH (the "Grantor") and NEW <br />ARADIGM REALTY, INC., a California corporation (the "Grantee"). <br />WITNESSETH: <br />,~? /. ~ a <br />WHEREAS, Grantor owns a parcel of real estate described as Lot 1 Concept <br />Subdivision, Grand Island, Hall County, Nebraska ("Easement Property") and Grantee owns a <br />parcel of real estate described as Lot 1 Concept Second Subdivision, Grand Island, Hall County, <br />Nebraska ("Benefited Property"). <br />WHEREAS, Grantor desires to grant to Grantee for the benefit of the Benefited <br />Property a perpetual easement far ingress and egress across the Easement Property subject to the <br />terms and conditions hereof. <br />NOW, THEREFORE IN CONSIDERATION OF One Dollar ($1.00), the mutual <br />covenants and agreements set forth herein, and other good and valuable consideration the receipt <br />and sufficiency of which is hereby acknowledged, the parties agree as follows: <br />1. Easement. Grantor hereby grants to Grantee, for its benefit and the benefit of <br />its successors and assigns, tenants, visitors, invitees, licensees and permittees, a permanent <br />easement for ingress and egress to access storage units on the eastern edge of the Benefited <br />Property over and across the currently existing private roadway extending from the 4th Street on <br />the northwesterly corner of the Easement Property adjacent to the westerly lot line and <br />approximately 26 feet measured perpendicular to the westerly lot line of the Easement Property <br />and running generally south and parallel tot the westerly lot line of the Easement Property a <br />distance of 611.27 feet. The location of the currently existing private roadway is shown on <br />Exhibit A, attached hereto and incorporated herein by reference. <br />2. Additional Terms.
