200903866 <br />Replacement Easement Area, and in that connection to enter upon the Temporary Easement Area <br />with vehicles, equipment, materials and personnel necessary for the performance of such work. <br />When the aforementioned work has been commenced, it shall be diligently pursued and <br />completed within thirty (30) days after commencement, and the Temporary Easement Area and <br />any portions of the Replacement Easement Area and any improvements thereon disturbed in the <br />completion of such work shall be restored to their condition prior to commencement of the work. <br />TLC, it successors or assigns, shall hold Casey's and its successors or assigns harmless from any <br />damages, injuries or liability arising from or related to the performance of the aforementioned <br />work. TLC shall provide Casey's twenty (20) days advance notice of its intention to exercise its <br />rights pursuant to this Temporary Construction Easement, except in cases of emergency. <br />3. TLC agrees that any advertising sign constructed upon the Replacement Easement <br />Area will consist of a single -pole sign with faces set parallel to the northerly lot line of the <br />Casey's Tract, with its base situated at the Center Point of the Replacement Easement Area or <br />within three and one -half feet (3.5') north or south thereof (measured at right angles to the sign <br />faces), having a maximum sign width of twenty -three feet (23'), a height of eleven feet (11'), a <br />sign face not to exceed 300 square feet (on each side), and a height to the bottom of the sign of at <br />least twenty -three feet (23'). Casey's agrees that electronic equipment serving or monitoring the <br />sign may be affixed to an arm extending outward from the sign, which may extend into airspace <br />outside the Replacement Easement Area, which extension shall be permitted. The sign pole will <br />have an approximate diameter of two feet, and there will be two sign faces, facing in opposite <br />directions. The sign structure shall comply in all respects with the ordinances of the City of <br />Grand Island. No other structures, except "ground facilities" related to the sign's function, <br />including telecommunication devices, may be constructed within the Replacement Easement <br />Area. Provisions of the Grant of Easement granting a right to construct and maintain <br />telecommunications towers are deleted therefrom. <br />4. Casey's will extend to the sign an underground electric service line providing 100 <br />amp electric power, with a meter pack situated on or inside Casey's facilities on the Casey's <br />Tract or adjoining property, so that electric power supplied to the sign may be separately metered <br />and billed to TLC or the operator of the sign. In consideration of Casey's undertaking to <br />construct an underground electrical service line, provisions of the Grant of Easement granting a <br />right of overhang for electrical service are deleted therefrom. <br />5. In consideration of the rights herein granted, and for other good and valuable <br />consideration, TLC covenants and agrees for itself, its successors and assigns, that any <br />advertising sign constructed on the Replacement Easement Area will not be used for the <br />advertising of donuts, pizza, gasoline, convenience stores or other businesses in direct <br />competition with Casey's General Stores, or abortion services. <br />6. Casey's agrees, for itself, its successors and assigns, that TLC's right of view, as <br />set forth in the Grant of Easement, prohibiting vegetation or improvements that would obstruct <br />the view of the advertising structure from the adjoining highway, shall apply to both the <br />Replacement Easement Area and the immediate surrounding area within the Casey's Tract. <br />Casey's proposed canopy over its fuel pumps and standard Casey's pylon sign, situated as shown <br />3 <br />
