<br />82~- UQ9948 <br />the limits of of not less than 5100,000.00 in respect to one <br />injury or death of a single person, and a limit of not less than <br />$300,000.00 in respect to any one accident, and a limit of not <br />less than $100,000.00 in respect to property damage with reason- <br />able deductible amount provisions. The Lessee shall furnish <br />certificates evidencing such insurance to the Lessor within sixty <br />(60) days after the execution of this lease. case Lessee <br />shall fail at any time to insure said risk as is herein provided, <br />sand to kea_p the same insured, the Lessor may at its election <br />insure such insurance and the amount paid therefore by the Lessor <br />(shall be additional rental due from the Lessee to the Lessor at <br />the next monthly rental date after such payment at interest- at <br />the rate of sixteer, percent (16~) per annum from the date of <br />payment until repayment thereof to the Lessor. <br />9. ?MATERIAL DAP7AGE INSURANCE. Lessor, at his expense, <br />(shall maintain insurance against loss to said building by fire, <br />extended coverage, and vandalism and malicious mischief in an <br />amount not less than $400,000.00. Lessee shall keep its trade <br />fixtures, equipment, and inventories insured against loss by fire <br />and other casualties covered under extended coverage in an amount <br />it deem appropriate. <br />10. PROTECTION FROA1 SUBROGATION. Neither the Lessee <br />nor the Lessor shall be liable to the other for any loss or <br />!damage to property on the leased property or the adjoining <br />(property or in ary manner growing out of or connected with the <br />Lessee's use and occupancy of the leased property, or the condi- <br />tion thereof, ar of-the adjoining property, whether or not caused <br />by the negligence or other fault of the Lessee or the Lessor or <br />of their respective agents, employees, licensees, or assigns. <br />This release shall apply only to the extent that said loss or <br />damage to property is r_overed by fire and extended coverage <br />insurance regardless of whether suer, insurance is payable to or <br />protects the Lessee, Lessor, or both.
