82-- U047yK It is further agreed by an3 between the parties hereto that if the purchaser should fail, refuse, or neglect to pay the purchase money and interest thereon as herein provided or should fail or neglect to pay any taxes or assessments before they become delin- quent, or should fail to keep and perform any of the other terms and. conditions of this agreement on her dart to be kept and performed as herein provided, then the vendors at their option may at once and without notice declare the whole amount of the purchase price remaining unpaid at once due and collectible and may maintain an action at law or equity to recover that amount or to foreclose this Contract, and the commencement of such action shall be the only notice of the exercise of such option required. It is further agreed that failure to exercise these options, or any of them, by the vendors at any time shall not constitute a waiver with respect thereto or caith respect to any subsequent breach of the terms of this Contract by the purchaser. The parties hereto respectively bind themselves, their heirs, assigns, successors, and legal representatives, to the faithful performance of the terms of this agreement. This Contract shall not be assigned by the purchaser unless the consent thereto of the vendors in writing shall have been first obtained. It is further agreed between all of the parties hereto that the vendors have executed a deed to the premises to the purchaser and have deposited it with Cunningham, Blackburn, VonSeggern, Livingston, Francis & Riley, depositary, to be held in escrow until full performance by the purchaser of the terms of this Contract. on aerformance, the vendors hereby direct and authorize the depositary and any of its employees to deliver the deed to the grantee. Should default be made in .any of the obligations of the purchaser to this Contract, the deed shall be returned to the. vendors.
