<br />4. As sdditiaaai security, TruaWr hereby gives to and confers upon Beneficiary, the right. power and authority, during the continuance
<br />oC these Trusts to collect the rents, issues and profits of said property, reserving unto Trvamr the right, prior to any default by Trustor
<br />in payment of any indebtedness eeartred hereby ar in performance of any agreement hereunder,-ta collect and retain such rents, issues
<br />and profits as they become due and payable. Upan any such default, Beneficiary may at any time without notice, either in person, by
<br />agent, or by a receiver to be appointed by a court, and without regard to the adequacy of any security for the indebtedness hereby secured,
<br />enter upon and take passeseion of said property or any part thereof, in his own name sue Cor or otherwise-collect such rents, issues-and
<br />profits, including those past due and unpaid, and apply the same upon any indehtednesa secured hereby, and in such order as Beneficiary
<br />map determine. The entering upon and taking possession of said property, the wllection of such rents. issues and profits and the applir~ition
<br />thereof as aforesaid, shalt not cure or waive any default or notice of default hereunder or invalidate any act done pursuant to such notice.
<br />5. Upon default by Trustor in the payment of any indebtedaeae secured hereby or in the performanr of any agreement contained herein,
<br />all soma secured hereby shall immediately became due and payable at the option at the Beneficiary. [n such event and upon written request
<br />oC Beneficiary, Trustee shalt sell the trust property, in accordance with the Nebraska Trust heeds Act, at public auction to the highest
<br />- bidder. Any person except Trustee may bid at Trustee's sale. Trustee shag apply [he proceeds of the sale as follows: (11 to the expense
<br />of the sale, including a reasonable Trustee's ter; r'l) to the obligation secured by this heed of Trust: i31 the surplus, if any, shalt be distributed
<br />to the persona entitled thereto.
<br />6. Trustee shat! deliver to the purchaser at the sale its deed, without warranty, which shag cnnvey to the purchaser the interest in
<br />the property which Trustor had or bed the power to convey ac the time of his execution of this Decd of Trust, and such as he may have
<br />acquired thereafter. Trustee's deed shall recite the facts showing that the sale. was conducted in rnmpiiance with aB the requirements
<br />of law and of Chis Deed of Trust, which recital shall be prima recta evidence of such complianre and conclusive evidence thereof in favor
<br />of bona fide purchasers and encumbrancars for value.
<br />7. The power of sale conferred by this Dead of 71-rrst is not an exclusive remedy; Beneficiary may cause this Deed of Trust io be foreclosed
<br />as a mortgage. -
<br />8. In the event of the death. ineapacity, disability or resiguuticn of Trustee, Beneficiary mac appoint in writing a successor trustee,
<br />and upon the recording of such appointment in the mortgage records oC the county iu which this Deed of Trust is recorded, the successor
<br />\ ~ trustee shall be vested with xll powers of the original tnretee. The trustee is uot. obliged to notify any l:ar4y hereto of pending sale under
