$~ ""'~~ t~ tl 1 "~ <br />REAL ESTATE MORTGAGE <br />This Mortgage is entered into between R. ESTHER OBERMEI- <br />ER, a divorced woman in her own interest as mortgagor, and <br />BAVID R. BENDER and EMILX F. BENDER, husband and wife, <br />herein referred to as "Mortgagee". <br />Mortgagor is indebted to mortgagee in the principal <br />suue of $31,DOb.42, evidenced by mortgagor`s note dated <br />December 31, 1981 providing for payment of principal and <br />interest if not sooner paid on April 15, 1989. <br />To secure the payment of the note and payment of other <br />sums, with interest, advanced by mortgagee to protect the <br />security of this mortgage, and the performance of the <br />covenants and agreeemnts of the mortgagor contained herein, <br />mortgagor does hereby mortgage and convey to mortgagee the <br />following described property located in Fall County, Nebraska: <br />Lot Twenty Three (23) in Block three (3} Olde <br />t?= 11 S1bdi yiSi~'°` }•^ ti`t.= City ~?~ Grai~d _Siand, <br />Hall. County, Nebraska. <br />together with all .buildings, improvements, fixture , <br />easements, rights, .priv.ileges and appurtenances located <br />thereon os in any way pertaining thereto, and the rents, <br />profits, reversions and remainders thereof; including rep- <br />lacements and additions thereto that are hereby declared. <br />to be a part of the real estate secured by the lien of this <br />mortgage and all of the foregoing being referred to herein as <br />the "property" <br />mortgagor further covenants and agrees with the mort- <br />gagees as follows: <br />1. Payment. ~o pay the indebtedness and the interest <br />thereon as provided in this mortgage and the note. <br />2. Title. Mortgagor is the owner o£ property, has the <br />right. and authority to mortgage the property, and warrants that <br />the lien created hereby is a fa.rst and prior lien on the property. <br />3. Taxes, Assessments. To pay when due all taxes, special <br />assessments and all other charges against the property and, <br />upon written demand my mortgagee, to add to the payments <br />required under the note secured 'Hereby, such amount as may be <br />sufficient to enable the mortgagee to pay. such taxes, assess- <br />ments or other charges as they become due. <br />4. Insurance. To keep the improvements now or hereafter <br />located on the real estate described herein irstxred against <br />damage by fire and such other Hazards as mortgagee may require, <br />in a~;ants and with companies acceptable to the mortgagee and <br />with loss payable to the mortgagee.
