<br />200900728 <br /> <br />T. "Project" means the condominium created by this Declaration. <br /> <br />U. "Properties" means each and every unit and or any portion or subsequent resubdivision <br />ofthose units, together with all common elements thereof. <br /> <br />V. "Rules and Regulations" means any rules and regulations adopted by the Board pursuant <br />to the terms of the Operating Agreement, as they may be amended from time-to-time. <br /> <br />W. "Unit" is that portion of the Project shown or designated in the Plats and Plans for <br />individual ownership and having a separate identifying number. The boundaries of a Unit shall be <br />the walls, floors, or ceilings and any materials constituting any part of those finished surfaces. <br /> <br />2. NAMES. <br /> <br />The name of the Project is PIC Condominiums. The name of the Association is Condominium <br />Owners Association of PIC Development, LLC., a Nebraska nonprofit corporation. <br /> <br />3. DESCRIPTION. The Project is situated in Hall County on the following described real estate: <br /> <br />Lot Five (5), KAAAR subdivision to the City of Grand Island, Hall County, Nebraska <br />("Property"). <br /> <br />4. BOUNDARIES. <br /> <br />The boundaries of each Unit, including the unit's identifying number, are as shown in the Plats <br />and Plans and stated in the definition of a Unit. <br /> <br />5. COMMON ELEMENTS. <br /> <br />The Common Elements are as stated in the definition of Common Elements. For purposes of <br />applying the Covenants to the Condominium, the Association shall be the "Lot Owner" as that term <br />is defined in the Covenants. Assessments to or obligations of a Lot Owner under the covenants shall <br />be a common expense and obligation of the Association. <br /> <br />The "Limited Commons" specifically include the following: <br /> <br />A. Any chute, flue, duct, wire, conduit, bearing wall, bearing column, or any other fixture lies <br />partially within and partially outside the designated boundaries of a unit, any portion thereof serving <br />only that unit is a limited common element allocated solely to that unit, and any portion thereof <br />serving more than one unit or any portion of the common elements is a part ofthe common elements. <br /> <br />B. Any shutters, awnings, window boxes, doorsteps, stoops, porches, balconies, patios, and <br />all exterior doors and windows or other fixtures designed to serve a single unit, but located outside <br />the unit's boundaries, are limited common elements allocated exclusively to that unit. <br /> <br />-3- <br />
