ADDITIONAL PROPERTY FOR COMMON USE. <br /> <br />The Association may acquire and hold for the benefit of the Owners real property and <br />tangible and intangible personal property, and the beneficial interest in any such property shall be <br />owned by the Condominium Owners in the same proportion as their Allocated Interest in the <br />Common Elements and shall not be transferable except with the transfer of a Condominium Unit. <br />Each Owner may use such real and personal property in accordance with the purpose for which it <br />is intended, without hindering or encroaching upon the lawful rights of the other Owners. <br /> <br />26. REGISTRA nON BY OWNER OF MAILING ADDRESS. <br /> <br />Each Owner shall register his/her mailing address with the Association, and except for <br />monthly statements and other routine notices, all other notices or demands intended to be served <br />upon an Owner shall be sent by either registered or certified mail, postage prepaid and addressed in <br />the name ofthe Owner of such registered mailing addresses. <br /> <br />27. AMENDMENT TO DECLARATION. <br /> <br />A. Procedure. Except as provided by ~ 76-854 of the Nebraska Uniform Condominium <br />Act and this Declaration, this Declaration may be amended only by vote or agreement of Members <br />of Units of which at least eight (8) of the votes in the Association are allocated. If a vote is taken <br />at an Association meeting, notice of the subject matter ofa proposed amendment shall be included <br />in the notice of any meeting at which a proposed amendment is considered. Resolutions for the <br />adoption of a proposed amendment may be proposed by either the Board or the Members of the <br />Association. <br /> <br />B. One Year. No action to challenge the validity of an amendment adopted by the <br />Association pursuant to this paragraph may be brought more than one year after the amendment is <br />recorded. <br /> <br />C. Recordation. Every amendment to the Declaration must be recorded in the office of <br />the Register of Deeds of Lancaster County, and is effective only upon recordation. <br /> <br />D. Amendments. Amendments to the Declaration required by the Nebraska Uniform <br />Condominium Act to be recorded by the Association shall be prepared, executed, recorded, and <br />certified on behalf of the Association by any officer of the Association designated for that purpose <br />or, in the absence of designation, by the President ofthe Association. The condominium established <br />by this Declaration may be amended, in writing, by the unite owners of two-thirds (2/3) of the units <br />at any time. <br /> <br />-16- <br />
