<br />200900539 <br /> <br />for a term of thirty (30) years from the date this Agreement is recorded after which time they shall be <br />automatically extended for successive periods of ten (10) years, unless changed or modified by a vote of a <br />majority of the then owners of the lots in said Subdivision. This agreement may be amended, or a variance <br />granted, during the frrst thirty (30) year period by an instrument signed by at least seventy percent (70%) of the <br />owners and approved by the Manager of the Centura Hills Golf Club, L.L.C. Any amendment to this <br />Agreement must be recorded with the Register of Deeds of Hall County, Nebraska. <br /> <br />17. Remedies for Violations. If any owner of any lot, or their heirs or assigns, shall violate or attempt <br />to violate any of the covenants, restrictions and conditions herein set forth, it shall be lawful for any other person <br />or persons owning Lots Two (2) through Twelve (12), Block One (1) and Lots Two (2) through Eighteen (18), <br />Block Two (2) of Centura Hills East Subdivision or by the Manager of the Centura Hills Golf Club, L.L.C., to <br />prosecute such proceedings at law or in equity against the person or persons violating or attempting to violate <br />any such covenants or restrictions and to prevent him from so doing or to recover damages for such violations. <br /> <br />In addition to the foregoing right, the Manager of Centura Hills Golf Club, L.L.c., its successors <br />and assigns, shall have the right to enter onto the property of an owner whenever there has been constructed on <br />the lot any temporary structures, signs, unused parts thereof, weeds, underbrush, or other unsightly growth or <br />objects in breach of these restrictions and to abate or remove the same at the expense of the owner, and any such <br />entry and abatement or removal shall not be deemed a trespass. The failure to promptly enforce any of the <br />covenants, restrictions or conditions of this Agreement shall not in any way be deemed a waiver of their <br />enforcement. <br /> <br />18. Covenant Declared Void. If any of the covenants, restrictions or conditions herein set forth are <br />violated. and declared void by a court of competent jurisdiction, the remaining covenants, restrictions or <br />conditions shall not be effected but shall stay and remain in full force and effect. <br /> <br />19. Ae:reement Hindine:.
