<br />200900539 <br /> <br />the office of the Register of Deeds of Hall County, Nebraska, that are sold, transferred and conveyed, shall be <br />and are subject to the following protective covenants, restrictions and conditions: <br /> <br />1. Use of Lots. Lots Two (2) through Twelve (12), Block One (1) and Lots Two (2) through Eighteen <br />(18), Block Two (2) of Centura Hills East Subdivision shall be known and described as residential lots. No <br />structure shall be erected, altered, placed or permitted to remain on any lot other than one dwelling and a private <br />garage for not more than three (3) cars, and other secondary buildings incidental to the residential use of the <br />plot. No dwelling shall be erected for occupancy for more than one family, nor shall any dwelling be used for <br />occupancy of more than one family. No structure of a temporary character shall be used as a residence. No <br />commercial or business enterprise shall be conducted or operated on Lots Two (2) through Twelve (12), Block <br />One (1) and Lots Two (2) through Eighteen (18), Block Two (2) of Centura Hills East Subdivision. No lot or <br />lots shall be divided or split to create smaller building areas, but lots may be combined or combined and divided, <br />to establish building areas. <br /> <br />2. Construction and Area Requirements. <br /> <br />A. Dwellings. Each residential lot with the exception of Lots Nine (9) through Twelve (12), Block <br />One (1) and Lots Fifteen (15) through Eighteen (18), Block Two (2) shall have no more than one (1) <br />dwelling thereon. Lots Nine (9) through Twelve C 12), Block One (1) and Lots Fifteen (15) through <br />Eighteen (18), Block Two (2), may have a condominium or townhouse with two separate living <br />areas (dwellings) per lot. <br /> <br />All dwellings shall meet the following minimum square feet requirements; which minimum square <br />footage shall not include garages or open porches: <br />(1.) Dwellings placed on lots with an average width of one hundred ten (110) feet or more <br />shall have a minimum of one thousand five hundred (1500) livable square feet on the first level <br />which shall be above ground. Dwellings placed on lots with an average width of less than one <br />hundred ten (110) feet shall have a minimum of one thousand two hundred fifty (1250) livable <br />square feet on the first level which shall be above ground. <br /> <br />(2.) The minimum livable square footage of any split level or split-foyer type dwelling shall <br />be one thousand five hundred (1500) livable square feet combined above ground and the <br />finished sub-basement of the dwelling shall not be included in computing the minimum livable <br />square footage. <br /> <br />(3.) Each dwelling on each residential lot shall have a roof constructed of architectural style <br />shingles, with 25-year warranty. The slope of each dwelling roof shall be a 5/12 pitch or more <br /> <br />(4.) No dwelling house shall be moved onto and placed upon Lots Two (2) through Twelve <br />(12), Block One (1) and Lots Two (2) through Eighteen (18), Block Two (2) of Centura Hills <br />East Subdivision nor shall manufactured housing, mobile homes or trailers be allowed on said <br />lots. <br /> <br />(5.) No fence shall be constructed closer to the street than the front elevation of the building. <br />No chain link fences of any type shall be constructed upon Lots Two (2) through Twelve (12), <br />Block One (1) and Lots Two (2) through Eighteen (18), Block Two (2) of Centura Hills East <br />Subdivision, except for dog pens. Maximum area of such pens shall be one hundred twenty <br />(120) square feet and shall be on a concrete pad. No dog runs shall be located in a front yard or <br />within five (5) feet of a lot line. <br /> <br />(6.) Any solar panels placed on any residence constructed on any lot shall be mounted flush <br />with the roof of such residence, and shall not be located along any exterior wall of such <br />residence or in any yard area of any lot. <br /> <br />Centura Hills East Subdivision, Restrictive Covenants <br /> <br />Page 2 of 5 <br />
