<br />AGREEMENT FOR COVENANTS
<br />. AND
<br />RESTRICTIONS ON USE OF PROPERTY

<br />This Agreement for Covenants and Restrictions on the Use of Property is pursuant to a
<br />Purchase Agreement between the Bank of Doniph.an, a Nebraska Corporation, (Seller) and
<br />Frederick Development, LLC, (Buyer) for the purchase of property legally described as Lot 3,
<br />Johnson Subdivision, Village of Doniphan, Hall County, Nebraska, hereinafter referred to as the
<br />"property. "

<br />Declaration: The Bank of Doniphan, as the Owner and Seller of the above described
<br />property, and Frederick Development, LLC, as the Buyer of the above described property, do
<br />hereby declare, affirm, and covenant with each other, and with their assigns and successors in
<br />interest, whomever they may be, that the following restrictions on the use of the property, legally
<br />described herein, shall become effective upon the filing of this agreement with the Hall County
<br />Register of Deeds, Hall County, Nebraska, and shall be in effect and binding on any and all
<br />individuals, parties, and owners of interest in such legally described property for a period of
<br />fifteen (15) years. This Agreement for Covenants and all restrictions contained herein shall
<br />terminate and end on January 23,2024.

<br />IN WITNESS WHEREOF The parties described above do hereby agree and covenant
<br />with each other, and with their assigns and successors in interest, that the following restrictions
<br />on the use of the property, described herein, shall be binding on all current and future owners of
<br />the property for a period of fifteen (15) years from the date of this agreement, or until January 23,
<br />2024, whichever date may come first:
<br />
<br />1. Restrictions regarding banks, financial institutions. and/or other businesses
<br />offering financial servi~es. and advertising by such businesses.
<br />Frederick Development, LLC, as Buyer, hereby covenants with the Bank of
<br />Doniphan, Seller, and agrees to Seller's restriction that no bank:, financial institution, or other
<br />businesses offering financial services or products of any kind shall be permitted to conduct
<br />business on the property for a period of fifteen (15) years from the date of this agreement, or until
<br />January 23, 2024, whichever date may come first. This restriction shall also include the
<br />advertisement or promotion by any bank, financial institution, or other businesses offering
<br />financial services or products of any kind on any signage owned by Frederick Development, LLC
<br />which is located on the property.
