<br />. <br />, <br /> <br />200809656 <br /> <br />4. <br /> <br />The following standards shall be applicablc to all commercial otl'ice structures <br /> <br />constructed within the Properties: <br /> <br />(a) All exterior colors shall be aesthetically pleasing and shall not <br />include any loud, bright or obnoxious color schemes. The change of any exterior <br />color of any office structure shall be approved by the Association in writing. <br /> <br />(b) Exposed foundation walls shall be painted or sided to match the <br />exterior color scheme of the office structure. <br /> <br />(c) Owner shall comply with al1 other requirements imposed by the <br />Subdivision Agreement appearing in that instrument recorded as Document No. <br />200510375 in the ofllee o[the Hall County Register of Deeds and applicable <br />regulations imposed by the City of Grand Island, Hall County, Nebraska. <br /> <br />5. 'I'he following standards shall be applicable to the construction and installation of <br />improvements other than the commercial omce units. <br /> <br />(a) Fencing shall not be constructed upon limited common elements <br />without the prior consent of the Association and such approval may be <br />conditioned upon Owner's payment of all Association expenses attributable to the <br />construction of such fence, including increased operating expenses associated <br />with the construction and maintenance of the fence. <br /> <br />(b) Accessory structures such as storage sheds or detached garages to <br />be constructed upon limited common elements must be first approved by the <br />Architectural Committee of Condominium Owners Association of North Point, <br />Inc. and the Association. <br /> <br />(c) No digital satellite dish larger than twenty inches in diameter shall <br />be permitted and any such permitted satellite dish shall be located and screened so <br />as to be as unobtrusive as is reasonably possible. <br /> <br />(d) Owner shall comply with all other requirements of applicable <br />regulations imposed by the City of Grand Island, Hall County, Nebraska. <br /> <br />6. Any wall constructed on any common line between two adjoining units within the <br />Properties shall be a party wall. Any expense of structural repair, replacement or reconstruction <br />of a party wall, or of the protection of a party wall against the natural elements, shal1 be borne <br />equally by the Owners who are the titleholders of the adjoining units. The provisions of this <br />paragraph shall not operate to relieve any Owner from any liability that the Owner may incur by <br />reason ofnegligcnt or willful acts or omissions resulting in damage to a party wall. <br />7. Each Owner shall be responsible for the proper storage and disposal of al1 <br />construction debris and materials associated with the construction attributable to any unit. Until <br />construction shall be completed upon any unit, the real estate shall be periodically mowed and <br />loose debris and material picked up and properly stored to prevcnt such loose debris and material <br />from being spread and blown throughout the Properties. During construction in respect to any <br />unit, the Owner ofthat unit shall be responsible to erect and maintain adequate erosion control <br />measures, including silt fences, straw bales, or other measures to prevent soil runoff upon <br />adjoining properties or streets. Each Owner shall be responsible for the enfc)fcement and <br /> <br />, <br />monitoring of all contractors and suppliers performing work upon their unit. Each Owner shall <br />be responsible for maintaining any improvements in respect to their unit or limited common <br />elements in a neat, safe, and attractive manner. <br /> <br />4 <br />
