<br />200809656 <br /> <br />(a) The Declarant may use any unit owned or leased by the Declarant as a <br />model, sales office or management office. <br /> <br />(b) Appoint or remove any officer of the Condominium Owners Association <br />of North Point, Inc. or any executive board member during any period of declarant <br />control herein provided for. <br /> <br />7. Allocated Interests. The allocated interests have been established based upon a <br />formula utilizing the number of units in the condominium. Since there are now seven (7) units <br />comprising the condominium, it is hereby declared that all allocated interest shall be based upon <br />the number of units, in the following manner: <br />(a) Voting. Each unit shall be entitled to one (I) vote in the conduct of the <br />condominium through the Condominium Owners Association of North Point, Inc. <br /> <br />(b) Common Expense Liability. Unit One (1) shall be responsible for and <br />shall be assessed for Twenty-Four Percent (24%) of all common expenses incurred by the <br />Condominium Owners Association of North Point, Inc.; Unit Two (2) shall be <br />responsible for and shall be assessed for Eleven Percent (1 1%) of all common expenses <br />incurred by the Condominium Owners Association of North Point, Inc.; Unit Three (3) <br />shall be responsible for and shall be assessed for Thirty Percent (30%) of all common <br />expenses incurred by the Condominium Owners Association of North Point, Inc.; Unit <br />Four (4) shall be responsible for and shall be assessed for Sixteen Point Five Percent <br />(16.50%) of all common expenses incurred by the Condominium Owners Association of <br />North Point, Inc.; Unit Five (5) shall be responsible for and shall be assessed for <br />Seventeen Point Five Percent (18.5%) of all common expenses incurred by the <br />Condominium Owners Association of North Point, Inc.; and Units Six (6) and Seven (7) <br />shall not be responsible for and shall not be assessed for any common expenses incurred <br />by the Condominium Owners Association of North Point, Inc.; <br /> <br />(c) Fractional Interest in Common Elements. Unit One (I) shall be allocated <br />a Twenty Percent (20%) undivided interest in and to the common clements of the <br />condominium; Unit Two (2) shall be allocated a Ten Percent (10%) undivided interest in <br />and to the common clements of the condominium; Unit Three (3) shall be allocated a <br />Twenty-Five Percent (25%) undivided interest in and to the common elements of the <br />condominium; Unit Four (4) shall be allocated a Ten Percent (10%) undivided interest in <br />and to the common elements of the condominium; Unit Five (5) shall be allocated a <br />Nineteen Percent (19%) undivided interest in and to the common elements of the <br />condominium; Unit Six (6) shall be allocated a Twelve Percent (12%) undivided interest <br />in and to the common elements of the condominium; and Unit Seven (7) shall be <br />allocated a Four Percent (4%) undivided interest in and to the common elements of the <br />condominium. <br /> <br />8. Conveyances. Any unit may be conveyed or encumbered, subject to the <br />provisions of this declaration. <br />9. Association. Condominium Owners Association of North Point, Inc. (association) <br />has been incorporated in Nebraska to provide for the management of the condominium. <br />10. Membership. Every person or entity who becomes a unit owner shal1 be a <br />member of the association. Any person who holds an interest in a unit merely as security for any <br />obligation shall not be a member. <br />I 1. Declarant Control. Declarant shall control the association and may appoint and <br />remove the officers and members of the Executive Board of Directors until the earlier of: <br /> <br />(a) Sixty (60) days after conveyance of Eighty-Three and One-Third Percent <br />(83 1/3%) of the units which may be created to unit owners other than the Declarant; or <br /> <br />(b) Two (2) years after Declarant has ceased to offer units for sale in the <br />ordinary course of business. <br /> <br />2 <br />
