UE;e <br /> <br />subject to the terms of this Agreement, the following described <br /> <br />right-of-way for the occupation of an existing building: <br /> <br />The public right-of-way known as John Street adjacent to <br />the Northeast Quarter of the Northeast Quarter (N~~) <br />of Section Twenty One (21), Township Eleven (11) North, <br />Range Nine (9) West of the 6th P.H., Ral1 County, <br />Nebraska, more particularly described as follows: <br /> <br />Commencing at a point in the Easterly line of Clark Street <br />where said line would be intersected by the Southerly line <br />of John Street, if extended, thence Southerly along said <br />Easterly line of Clark Street Fifty (50) feet, thence <br />Easterly at right angles, One Hundred Twenty four (124) feet, <br />thence Northerly, at right angles, Fifty (50) feet, to what <br />would be the Southerly line of John Street, if extended, <br />thence lIesterly, along said Southerly line, One Hundred <br />Twenty four (124) feet, to the place of beginning, being <br />a rectangular piece of ground, having a westerly frontage <br />of Fifty (50) feet on Clark Street a depth of 124 feet, <br />and bounded on the North by the eA~ended Southerly line <br />of John Street; <br /> <br />for a depth of 3.7 ;eet and a width of 12,6 feet, provided the Licensees <br /> <br />shall not occupy the aforesaid right-of-way without permission for any <br /> <br />use other than the present location of said existing building. <br /> <br />2, It is understood and agreed that the Licensees may construct <br /> <br />and maintain the existing building in the public right-of-way above defined <br /> <br />at their own risk. The Licensees hereby waive any claim for damages against <br /> <br />the City of Grand Island, its officers, agents, employees and independent <br /> <br />contractors for any damage or injury that may result to said existing building <br /> <br />being located in the City right-of-way. <br /> <br />3, The Licensees shall indemnify and hold harmless the City from <br /> <br />and against any and all loss and damage, and any and all claims, demands, <br /> <br />suits, liabilities and pa)cments in contract or in tort, penal or otherwise, <br /> <br />resulting from or in respect to the Licensees' use of the City right-of-way <br /> <br />from the aforesaid existing building. <br /> <br />-2- <br /> <br />u <br /> <br />L <br /> <br />I <br />L...- <br /> <br />I <br />----l <br /> <br />L <br />
