The Subdivider agrees to landscape an area <br />averaging thirty feet in width adjacent to Webb Road and U.S. <br />Hishway 281, and an area averaging twenty-three feet in width <br />adjacent to State Street. Such landscaping shall be completed <br />within one planting season after the completion of the widening of <br />Webb Road, and shall be in compliance with the Grand Island City <br /> <br />Code. <br /> <br />9. Warranty. The Subdivider warrants that it is the owner <br />in fee simple of the land described and proposed to be known aa <br />GRAND ISLAND MALL FIFTH SUBDIVISION, and that an abstract of title <br /> <br />or a copy of a valid title insurance policy will be submitted for <br />examination, if necessary, upon request of the City of Grand Island. <br />10. This agreement shall run with the land and shall be bind- <br /> <br />ing upon and inure to the benefit of the parties hereto, their <br /> <br />successors, assigns, heirs, devisees, and legatees.
