t: , r -4- 83-005328 shall be the sumof $15,999.96 per year, paya):>le. at the rate of $1,333.33 per month with the first such payment being due and payable on the date the option is exercised, with subsequent payments being d~e in advance upon the first of each month thereafter. Additional terms of this option are as follows: 1. This option shall be exercisable at any time within the twenty year term as provided for in the lease agreement above set forth and shall be exercised by Lessee by notifying Lessor of such exercise by certified letter or hand delivered notice, together with an initial month's rent payment. Lessee shall be entitled to possession of said premises from and after exercise of option as herein set forth; 2. In the event Lessee did not obtain approval of the Federal Department of Environmental Control prior to exercise of the option, Lessee shall have a period of 90 days thereafter within which to do so and the effective date of the lease shall be extended accordingly with Lessee receiving credit for one month's rent payment having tendered a like amount together with the notice of exercise; 3. In the event Lessee fails to receive such approval within the time allowed then the lease as exercised shall be null and void and of no force and effect and Lessor may retain the initial payment; 4. In the event the lease provided for in the above and foregoing lease agreement covering the SW~ of the sw}; of the same section is null and void by reason of failure to obtain necessary appLoval of the Federal Department of E.'1vironmental Control, then the option herein contained shall likewise be null and void and of no force and effect and Lessor agrees. to and \/:i:ll refund to Lessee the s1.llll of $2500 which constitutes a portion of the con- sideration fOr the within option.
