In consideration of final <br />acceptance of the plat of said Johnson Subdivision, the subdividers <br />hereby consent and agree with the Village of Doniphan, Nebraska, <br />that they will install, at their expense, the following improvements: <br />1. Paving. Paving and sidewalks shall be installed to <br />village specifications within four months of the earliest date of <br />anyone of the following occurrences: <br />(al Upon the issuance of a building permit <br />for Lot One in Johnson Subdivision. <br />The paving and sidewalks shall be <br />installed by Bosselman, Inc. and the <br />Bank. of Doniphan. <br /> <br />(b) whenever a final subdivision is <br />approved by the Village Board of <br />Doniphan for property adjacent to <br />any portion of Sixth Street, the <br />improvements shall be installed <br />by creation of a pavement improvement <br />district with property on each side <br />of Sixth Street sharing the improve- <br />ment costs as determined by law, <br />and fux"ther provided that the right-ot- <br />way of Sixth Street shall be relocated <br />by appropriate dedication and vacation <br />action to equally share the right-of-way <br />requirements on a 30 foot by 30 foot street. <br />and provided further that Bosselman, Inc. <br />and the Bank of Doniphan, their heirs and <br />assigns hereby agree not to object to the <br />creation of a pavement improvement district <br />upon the occurence of the conditions set <br />forth herein. <br /> <br /> <br />(cIOn August 1, 1993, if neither of the <br />previous items have occurred, the improve- <br />ments shall be installed by Bosselman, Inc. <br />and the Bank of Doniphan.
