ION, a <br />State of Nebraska, Grantor, and CITY OF <br />a municipa.l corporation of the State of <br />post.al address is Box 1968, City Hall, <br />, Nebraska 68801, Grantee: <br /> <br /> <br />WITN:eSSET1l, That Grantor, for and in consideration <br />of the slim of One Dollar ($1.00) and other good and valuable <br />con.sideration, has granted, bargained, sold and conveyed, and <br />by these presents does grant, bargain, sell and convey unto <br />Grantee, and unto its SUCCessors and assigns, a PERPETUAL <br />EASEMENT ror the operation, maintenance, repair, renewal, re- <br />location, reconstruction and use of an existing ten-inch <br />(10") water pipeline (hereafter "pipeline") upon, along and <br />under the~ surface of the land situate in the Northeast <br />Quarter (NE 1/4) of Section 15, Township 11 North, Range 9 <br />West elf t~he Sixth Pr incipal Meridian in the County of Hall, <br />State of Nebraska, described in Exhibit A, hereto attached <br />and hereby made a part hereof; together with the right of <br />ingress i:md egress to and from said land for the purpose of <br />exercising the rights herein granted. <br /> <br />RESERVING, however, to Grantor, its successors and <br />assigns, the right to construct at any and all times and to <br />maint~aiin roads, highways, railroad tracks, pipeli nes and <br />telephone', telegraph and electric power pole and wire lines, <br />over, under ,and across (but in such a way as not unreason- <br />ably t:o intet"fere with) said pipeline of Grantee on the <br />premis,es described in Exhibit Ai it being understood that <br />the right so reserved to Grantor, its successors and assigns, <br />is retained along with the general right of Grantor, its suc- <br />cessors and assigns, to the use of said premises for any pur- <br />pose not inconsistent with the use by Grantee of said <br />easement for the purposes herein defined. <br /> <br />This deed is made subject to all outstanding leases <br />and other outstanding rights, including, but not limited to, <br />those for highways and other roadways and rights of way for <br />irrigation ditches, pipelines, pole and wire lines and the <br />right of renewals and extensions of the same, and subject <br />also to all conditions, 1imitatio.ns, restrictions, en- <br />cumbrances, reservations or interests of any person which <br />may affect the said land, whether recorded or unrecorded. <br /> <br />Grantee, to the extent it may lawfully do so, for <br />itself, its successors and assigns, by the acceptance of <br /> <br />
