<br />83_002814 <br /> <br />appear hereunder. <br /> <br />(6) SELLER'.S OBLIGATION AS TO .FIRST NATIONAL BANK MORTGAGE: <br /> <br />Seller agrees to not permit the said first mortgage against <br />said premises in favor of the First National Bank of Marquette, <br />Nebraska, to become in default. The Seller agrees to promptly <br />make the mortgage loan payments required under said mortgage. <br />If the Seller should permit such mortgage to become in default <br />for failure to pay the monthly payments, Buyers may pay such <br />monthly mortgage payments and shall receive credit thereof <br />against the amount owing by them to the Seller and may utilize <br />such credit to apply upon their monthly payments hereunder. <br />At such time as the Buyers are ready and prepared to pay the <br />full balance owing the Seller hereunder, the Seller agrees to <br />obtain a release from the First National Bank of Marquette, <br />Nebraska of said mortgage against these premises, and the <br /> <br />balance payable by the Buyers to the Seller, hereunder, may <br /> <br /> <br />be applied at that time, toward payment of such First National <br /> <br /> <br />Bank of Marquette, Nebraska, mortgage payment. <br /> <br /> <br />(7) It is understood and agreed by and between the parties <br /> <br /> <br />hereto that the Buyers have inspected the premises and the <br /> <br /> <br />fixtures intended to be conveyed by this document and take <br /> <br /> <br />the same on an "as is" basis with no warranties of fitness <br /> <br />express or implied by the Seller. <br /> <br /> <br />(8) The Buyers agree that in the event that they desire to <br /> <br /> <br />make any major structural changes in the said home, that they <br /> <br /> <br />must first obtain the written approval of the Seller, which <br /> <br /> <br />approval will not be unreasonably withheld. <br /> <br /> <br />(9) PREPAYMENT OPTION: The parties do hereby mutually <br /> <br /> <br />agree that this contract may be prepaid at any time prior to ] <br /> <br /> <br />the termination date of said contract and that the Buyers will <br /> <br /> <br />not incur any prepayment penalty whatsoever. <br /> <br />(10) DEFAULT: If Buyers shall fail to make any payment pay- <br /> <br /> <br />able by them hereunde;r' commencing with the first payment on <br /> <br />April 1, 1982, or if Buyers should fail to perform any of J <br /> <br />the other obligations binding upon them herein set forth, Seller <br /> <br />
