<br /> <br />83- 002696 <br /> <br />9. NO CHANGE IN LEASE A.GREEMENT EXCEPT IN WRITING. It is <br />agreed that no change or changes shall be made in this Lease <br />Agreement except by writing signed by the parties hereto, <br />setting forth the terms of the agreed modification. <br /> <br />10. TIME OF THE ESSENCE FOR PAYMENT OF RENT. It is under- <br />stood and agreed between the parties that time is of the essence <br />as to the payment of the monthly rental. <br /> <br />ll. WAIVER OF CONDITION OR COVENltNT BY LESSOR. No waiver <br />of any condition or covenant of this Lease by Lessor shall be <br />deemed to imply or constitute a further waiver by Lessor of any <br />other condition or covenant under this Lease. The rights and <br />remedies created by this Lease Agreement are cumulative, and <br />the use of one remedy shall not be taken to exclude or waive <br />the right to the use of another. <br /> <br />12. PEACEABLE ENJOTI1ENT OF PREMISES BY LESSEE. Subject to <br />the terms and conditions and covenants of this Lease, the Lessor <br />agrees that the Lessee shall and may peaceably have, hold and <br />enjoy the leased premises above described, without hindrance by <br />Lessor. At the expiration of this lease, Lessee shall without <br />demand quietly and peaceably deliver up possession of the demised <br />premises in as good condition as they shall be at the time of <br />occupancy of the premises by Lessee, normal wear and tear and <br />decay and damage by the elements alone excepted. <br /> <br />13. LESSOR'S RIGHTS UPON DEFAULT OF LESSEE IN PA.YMENT OF <br />RENT. Lessee agrees to pay the rent i^lithout demand on the terms <br />and conditions hereinabove set forth and perform all the Lessee's <br />obligations under this Lease, and, in the event the Lessee shall <br />default, or fail to perform all of the obligations required <br />under the terms of this Lease, the Lessor may, in addition to <br />other remedies provided by law and ot,herwise herein set forth: <br /> <br />(a) Terminate this lease; <br /> <br />(b) Re-enter the premises; or <br /> <br />(c) Upon termination of the Lease during the term, <br />re-let the premises for the Lessee's account, but the Lessor <br />shall not be obligated to re-let the premises. <br /> <br />14. OPTION TO PURCHASE. In the event Lessor, or survivor <br />of them, or their heirs, executors, adrninstrat.ors, successors <br />or assigns, intend to sell the leased premises, or all of said <br />Lot Four (4), Block Thirty-three (33), and/or all of said Lot <br />Five (5), Block Sixteen (16) of which the leased premises are <br />a part at any time during the term of this lease, or any re- <br />newal thereOf, Lessee shall have the first option to purchase <br />at the same price and on the ~3ame terms and conditions as <br />Lessor will sell to any bona fide purchaser. In that event <br />Lessor agrees to give Lessee 30 days notice in writing of the <br />intention to sell setting forth the price, terms and conditions. <br /> <br />15. OPTION TO RENEW. If Lessor, or either of them, is <br />living at the t,ime of expiration of the original lease, and <br />the premises shall continue to be leased, Lessee shall have the <br />first option to extend this lease for an additional five (5) <br />year period at the same rental and on the same terms and comli- <br />tions as set forth in this original lease. <br /> <br />16. BINDING EFFECT OF LEASE AGREE~ENTo This Lease Agreement <br />shall be binding upon and inure to the benefit of the heirs, <br />execut~l:'s, administrators, legal representatives, successors <br />and .assigns of the Lessee and Lessor. <br /> <br />-3- <br />
