ROWLEY, AjK/A MAE - ' <br />ROWLEY and also as MAY AOWLEY,; <br />Appellee. , <br />ORDER <br />Per Curiam. <br />This matter came on to be heard on this ~ day of Decemher, <br />1982 on the report of the Prehearing Conference Officer and the <br />Soint Motion for Dismissal of Appeal containing the provisions of <br />the compromised settlement between the appellant and appellee. The <br />Court being fully advised in the premises finds and determines that <br />the Settlement Agreement be approved. <br />The Decree of the trial court in. this quiet title action was <br />entered on November 15, ?981 by the District Court of Ha11 County., <br />Nebrasca, which Decree nrevi:es as follows: <br />"This quiet title action came on regularly for trial on <br />Septeriber 16, 1981, at 9:00 a.;tt., before *_he Court without a <br />jury. Plaintiff appeared in person and with her attorney, <br />Kenneth H. Elsan. Defendant- Francis lRichael Caveny, also <br />known as Michael Francis Caveny, Personal Representative of <br />the Estate of James Leo Caveny, deceased, appeared in person <br />and with his attorney, Sohn A. t4agoner. Defendant Esther <br />Trentman appeared in person, and with her attorneys, Lloyd <br />W. Kally and O. William VorrSeggern. Refendant Charles <br />McTavish failed to plead or appear at the trial and is in <br />default. The respective partic>s appearing at trial intro- <br />duced evidence, oral and documentary, and rested.
