<br />STATE OF NEBRASKA, COONTY OF HALL:
<br />Mary A. Rowley, being first duly sworn, deposes and says as
<br />follows:
<br />1. Affiant is the owner of record of the following described real
<br />estate situated in Hall County, Nebraska:
<br />TRACT A: Southwest Quarter of the Northwest Quarter (SW'1tNW'~)
<br />of Section Sixteen (16}, Township Ten (10) North, Range
<br />Eleven (11), West of the 6th P.M. in Hall County, Nebraska,
<br />and
<br />TRACT B: t7orth Half of the Northwest Quarter of the South-
<br />west Quarter (N~NW~SW~) of Section Sixteen (16-, Township
<br />Ten (10) Ciorth, Range Eleven (11-, West of the 6th P.M. in
<br />Hall County, Nebraaska,
<br />and that she zs now in possession thereof.
<br />2. Affiant, who zs also known as Mae Rowley and as May Rowley,
<br />filed an action in the District Court of Ball County, Nebraska,
<br />against Francis Michael Caveny, et al., Case No. 72-088, for quiet-
<br />ing title in affiant to Tract A described above and to an undivided
<br />one-half interest in Tract B described above, as a result of which
<br />an appeal aas taken to the Supreme Court of the State of Nebraska
<br />resulting in an Order being entered on December 17, 1982, showing
<br />compromise settlement of the aispute resulting in an exchange of
<br />Quitclaim Deeds whereby affiant acquired fee simple title to both
<br />Tract A and Tract B, a copy of the Order of the Supreme Court of
<br />the State of Nebraska being attached to this Affidavit and incor-
<br />porated by reference.
<br />3. At his death, James Leo Caveny was the owner of an undivided
<br />one-half interest in Tract B described above, which undivided
<br />one-half interest was devised by him in his probated Last Will and
<br />Testament duly probated in the County Court of Hall County, Nebraska,
<br />Estate No. 36-I33, to Esther Trentman, as a part of his residuary
<br />real estate, James Leo Caveny having died on December 28, 1977, and
<br />Esther Trentman, as a part of the canpromise settlement of the
<br />dispute with affiant, conveyed to affiant by a Quitclaim Deed all
<br />of the right, title and interest of Esther Trentman in and to
<br />Tract B described above, as shown by the Quitclaim Deed filed of
<br />record in the Office of the Register of Deeds of Hall County,
<br />Nebraska, an November 23, 1982, recorded as Document No. 82-005000,
<br />4. Affiant files this Affidavit of record for documentary proof
<br />affiant is the owner of record of the real estate described in this
<br />Affidavit. ~--; ~^~
