<br /> <br />I <br /> <br />83- 001750 <br /> <br />certified mail. The escrow agent, on receipt of proof of notice <br />and after the expiration of thirty (30) days, shall deliver the <br />deed or deeds to the Purchasers. <br /> <br />The opening escrow fee is to be paid by Vendors and the <br />closing escrow fee is to be paid by Purchasers. <br /> <br />Purchasers agree to commit no waste on the real estate sold <br />hereby and to keep said real estate and improvements thereto in <br />good repair. Purchasers further agree to pay the reasonable <br />cost of any attorneys fees incurred by Vendors if necessary to <br />enforce the terms of this contract. <br /> <br />Purchasers, in consideration of the execution of this <br />contract, do hereby assign, transfer and set over to the Vendors <br />as security for the payment of this contract so long as the con- <br />tract remains executory and unperformed by the Purchasers, all <br />of the rents and revenues derived from any rental of the real <br />estate, and the Purchasers, during this time, hereby authorize <br />the Vendors to rent the premises and to collect the rents and <br />apply the rentals to the payment of any obligations or sums due <br />Vendors under this contract. On full performance by the Purchasers, <br />this assignment shall be void. <br /> <br />It is further agreed by and between the parties hereto that <br />if the Purchasers should fail, refuse or neglect to pay the pur- <br />chase money and interest thereon as herein provided or should <br />fail or neglect to pay any taxes or assessments before they be- <br />come delinquent, or should they fail to keep and perform any of <br />the other terms and conditions of this agreement on their part <br />to be kept and performed as herein provided, then the Vendors at <br />their option may, if such defect is not cured within a 20 day <br />notice in writing, declare the whole amount of the purchase price <br />remaining unpaid at once due and collectible and maintain an <br />action at law or equity to recover that amount or to foreclose <br />this contract, and the commencement of such action shall be the <br />only notice of the exercise of such option required. <br /> <br />It is further agreed that failure to exercise these options, <br />or any of them, by the Vendors at any time shall not constitute <br />a waiver with respect thereto or with respect to any subsequent <br />breach of the terms of this contract by the Purchasers. <br /> <br />The Purchasers further agree to carry appropriate liability <br />insurance on said premises and fire and extended coverage on <br />insurable improvements on said premises, in appropriate amounts, <br />with the Vendors named as additional insureds thereunder. <br /> <br />The parties hereto respectively bind themselves, their heirs, <br />assigns, successors and legal representatives, to the faithful <br />performance of the terms of this agreement.
