In <br /> <br /> <br />consideration of the acceptance of the plat of said BOSSELMAN <br /> <br /> <br />BROTHERS SUBDIVISION, the Subdividers hereby consent.and agree with <br /> <br /> <br />the City of Grand Island, Nebraska, that they will install or <br /> <br /> <br />provide at their expense the following improvements: <br /> <br /> <br />1. Water. 'Public water service is available to the sub- <br /> <br /> <br />div~sion, and the Subdividers agree to'connect all new struct- <br /> <br /> <br />ures in the subdivision which require domestic water to water <br /> <br /> <br />service before applying for occupancy permits. <br /> <br /> <br />2. Sanitary Sewer. Public sanitary sewer service is <br /> <br /> <br />available to the subdivision, and the Subdividers agree to <br /> <br /> <br />connect all new structures in the subdivision which require <br /> <br /> <br />sanitary sewer service,to the sanitary sewer system before apply- <br /> <br /> <br />ing for occupancy permits. <br /> <br /> <br />3. Setback. All new buildings constructed on lots adja- <br /> <br /> <br />cent to U. S. Highway 30 shall have a setback of fifty (50) feet <br /> <br /> <br />from the public right-of-way. <br /> <br /> <br />4. Landscaping. The Subdividers agree to landscape an <br /> <br /> <br />area averaging thirty (30) feet in width adjacent to U. S. High- <br /> <br /> <br />way 30 on Lots 2, 3, and 4 of the subdivision, pursuant to <br /> <br /> <br />requirements of Section 32-13(3) of the Grand Island City Code; <br /> <br /> <br />such landscaped area shall include a suitable screen or site- <br /> <br /> <br />obscuring fence, foliage, or other screening material if the <br /> <br /> <br />lot is used for storage of unassembled or unfinished material <br /> <br /> <br />or inoperable equipment or inoperable automotive vehicles. Such <br /> <br /> <br />landscaping shall be completed within one planting season after <br /> <br />the lots are built upon. <br /> <br /> <br />5.' Warranty. The undersigned owners, as Subdividers, <br /> <br /> <br />warrant that they are the owners in fee simple of the land <br /> <br /> <br />de~iblKi and proposed to be known as HOSSELMAN BROTHERS <br /> <br /> <br />SU.'IVlSlON. and that an abstract of title or title insurance <br /> <br />- 2 - <br />
