<br />83- 001639 <br /> <br />without demand or notice, immediately repaid by mortgagor to <br />mortgagee with interest thereon as set forth in the note from the <br />date of such advance. <br /> <br />5. Default. Time is of the essence hereof and upon <br />mortgagor's default in any covenant or agreement of this <br />mortgage, including covenants to pay when due sums secured by <br />this mortgage, mortgagee shall be entitled, at its option and <br />without notice, to declare all sums secured by this mortgage to <br />be immediately due in payable and may commence foreclosure of <br />this mortgage by judicial proceedings. <br /> <br />6. Transfer of the Property. If all or any part of <br />the Mortgaged Property is sold or transferred without express <br />written consent of the mortgagee, mortgagee may at its sole <br />option declare all sums secured by this mortgage to be <br />immediately due and payable. <br /> <br />7. Miscellaneous. <br /> <br />(al The covenants herein contained shall bind and <br />the benefits and advantages shall inure to the respective <br />successors and assigns of the parties hereto. Whenever used, the <br />singular number shall include the plural, the singular, and the <br />use of any gender shall include all genders. <br /> <br />(bl No waiver of any covenant herein or the <br />obligations secured hereby shall at any time thereafter be held <br />to be a waiver of the terms hereof or the note secured hereby. <br /> <br />(cl A judicial decree, order, or judgment holding <br />any provision or portion of this instrument invalid or <br />unenforceable shall not in any way impair or preclude the <br />enforcement of the remaining provisions or portions of this <br />instrument. <br /> <br />(dl Any written notice to be issued to the <br />Mortgagor pursuant to the provisions of this instrument shall be <br />addressed to the ~lortgagor at <br /> <br />and any written notice to be issued to the Mortgagee shall be <br />addressed to Hortgagee at: National Bank of Commerce Trust and <br />Savings Association, P.
