<br />I <br /> <br />LEASE AGREEMENT <br /> <br />.83:- ..1062' <br /> <br />This Lease Agreement made and entered into this <br />day of December 1981, by and between LARRY D. PARTRIDGE, <br />hereinafter referred to as Lessor and ROLLIN PACKER, hereinafter <br />referred to as Lessee. <br /> <br />WITNESSETH: For and in consideration of the mutual <br />covenants herein contained and the valuable consideration to <br />be paid, the Lessor does hereby lease and let unto Lessee <br />110 tillable acres, more or less, located in the Northwest <br />Quarter of the Northwest Quarter (NW~NW~) and Lot Two (2) <br />and part of Lot Three (3) on the island and part of Lot Two <br />(2) on the mainland, all located in the Northwest Quarter <br />(NWlo.) of Section Five (5), 'Township Nine (9) North, Range <br />Eleven (11) West of the Sixth P.M., in Hall County, Nebraska. <br /> <br />This lease is made upon the terms and conditions and <br />for the rentals to be paid as hereinafter set forth: <br /> <br />1. The Lessor by this Lease Agreement does hereby <br />lease and let the above described premises to the Lessee for <br />the period of five years beginning on the 1st day of March, <br />1982 and ending on. the 28th day of February, 1987. <br /> <br />The Lessee covenants and agrees to pay as rent the <br />following amounts: On July 1, 1982 and on November 1, 1982 <br />two payments of S5,800.00, each; on July 1, in the year <br />1983 and on November 1, 1983 two payments of $6,900.00 each <br />and on ,July 1 and November 1, in each of the years, 1984 <br />1985 and 1986 - $9,900.00 each payment. <br /> <br />2, The Lessee covenants and agrees that Lessor shall <br />have a lien upon all and any part of the crops growing or <br />gathered on the premises during the term of this Lease, as <br />well as the proceed~ of those crops. This lien shall remain <br />in full force and effect until the rental terms of the <br />Lease, as herein set forth, have been fulfilled. <br /> <br />3. The Lessee shall do at its expense the necessary <br />leveling and Lessee shall install and own the pump and the <br />power unit for operating the pump. <br /> <br />4. The Lessee shall pay the balance of the maintenance <br />expense not covered by warranty or landlord's share and <br />shall pay all other costs of maintaining the property ~nd <br />qrowinq tr,e crops .I'I\~ ./ \4Sb<'.wd. The Lessee shall, at Lessee' s expense, seed the <br />ground with annual rye grass after the potatoes are harvested <br />each year during the term of this lease. <br /> <br />6. After the Lessee removes Lessee's potato crop each <br />year during the term of this Lease and reseeds the ground <br />into rye gr~ss, Lessor shall have the sole and exclusive <br />right to use the real estate for pasture until time for the <br />planting of the next potato crop. <br /> <br />7. Lessee shall pay all real estate taxes assessed <br />against the premises including the irrigation pivot system <br /> <br />-1- <br />
