Mann, a Nebraska Resident, and Wells Fargo Bank, N.A. <br /> <br />WHEREAS, by warranty deed dated on July 10, 2006, and recorded July 17, 2006 as <br />Instrument Number 0200606351 in the Office of the Hall County Register of Deeds, Jon <br />K. Metcalf and Lynn A. Metcalf (hereinafter the "Metcalfs") conveyed real property <br />located in Grand Island, Hall County, Nebraska to Sara R. Mann, Anthony P. Mann, and <br />Carol L. Kaiser as joint tenants. The real property has a commonly known street address <br />as 2539 Jan Street, Grand Island, Nebraska, 68803, and is legally described as: <br /> <br />Lot Ten (10), Block One (1), Jenkinson Subdivision, Hall County, <br />Nebraska. <br />(hereinafter the "Subject Property") <br /> <br />WHEREAS, in order to purchase the Subject Property from the Metcalfs, Anthony P. <br />Mann and Carol L. Kaiser obtained two loans from Wells Fargo Bank, N.A. The first <br />loan was for the principal amount of $153,600.00 (hereinafter the "Loan"), and was <br />evidenced by a Promissory Note executed and delivered by Anthony P. Mann and Carol <br />L. Kaiser payable to the order of Wells Fargo Bank, N.A. dated July 14,2006 (hereinafter <br />the "Promissory Note"). Wells Fargo Bank, N.A. distributed the proceeds from the Loan <br />for the benefit of Anthony P. Mann and Carol L. Kaiser on or about July 14,2006. The <br />Promissory Note is secured by a Deed of Trust dated July 14,2006, executed by Anthony <br />P. Mann, Carol L. Kaiser, and Sara P. Mann for the benefit of Wells Fargo Bank, N.A. <br />(hereinafter the Deed of Trust").
