U) (jl c: <br /> G.J CD <br /> t'- ^ s: <br /> :r-.... <br /> 0> CJ1 N IT. <br /> --- --- 3j <br /> 0') Ul CJl <br /> Ul 2': <br /> 0 <br /> <br /> <br /> <br />~ <br />YOa <br /> <br />200808925 <br /> <br />DECLARA nON CREATING <br />FROSTFIRE AVENUE CONDOMINIUMS PROPERTY REGIME <br /> <br />This Declaration is made this First day of October, 2008, by Larson Brick and Masonary, <br />Inc., a Nebraska Corporation, for itself, its successors, grantees and assigns. <br /> <br />I. <br />The name of the Condominium being created is Frostfire Avenue Condominiums <br />Property Regime; the name of the Association is Frostfire Avenue Condominiums Property <br />Regime Homeowners Association. <br /> <br />II. <br />The land owned by the Declarant which is submitted to the Condominium Regime is <br />described as follows: <br /> <br />Lots 18 and 19, Larue Subdivision, in the City of Grand Island, Hall County, Nebraska. <br /> <br />The Declarant reserves the right to add additional land to the Condominium Regime by <br />later Declaration Amendments. The initial number of suites created under this Condominium <br />Regime are two (2), Suite 1 and Suite 2. <br /> <br />III. <br />The boundaries of the unit created by this Declaration are identified in the accompanying <br />plat which shows the description and location of limited common elements. The plat attached <br />hereto marked Exhibit "A" and incorporated herein by reference sets forth the boundaries of each <br />unit. <br /> <br />IV. <br />The condominium consists of one (1) building which includes basements and attached <br />garages. Each building is one (1) story in height for all of the suites. Each building will contain <br />two (2) suites which may only be used for residential purposes. The total square foot area of the <br />building contains 3,746.89 square feet and the total land area of the Regime is depicted on the <br />attached Certificate. The building and its improvements together with its location on the land <br />and the area and location of each suite are more particularly described in the Plan which is <br />attached hereto as Exhibit "A". <br /> <br />V. <br />Each owner shall be responsible for the repair, maintenance and replacement of all <br />exterior doors, including doors and mechanical operators thereof appurtenant to said owner's <br />suite or garage, it being understood that the only Association maintenance of exterior doors shall <br />be the painting or finishing of the exterior surfaces thereof. If any owner fails to repair, maintain <br />or replace the exterior portion of his or her suite as set forth in this Declaration, the Association <br />created may perform such work, invoice the owner thereof and secure and enforce a claim and <br />lien therefore against the owner and his or her unit in a like manner as a delinquent assessment <br />for common element expense. <br /> <br />t_ <br />
