<br />THIS AGREEMENT made ~JXku I d- ,2005. between John H. Olson and Debra K.
<br />Olson, husband and wife, of Doni ph an, Hall County, Nebraska, hereinafter referred to as "Grantor",
<br />and the Village of Doniphan, a Municipal Corporation organized and existing under the laws of the
<br />State of Nebraska, located in Hall County, Nebraska, hereinafter referred to as"Grantee"

<br />SECTION I.
<br />
<br />RIGHT-OF-WAY
<br />
<br />In consideration ofthe sum of One Dollar ($1.00) and other good and valuable consideration,
<br />receipt of which is hereby acknowledged, Grantor grants, sells and conveys to Grantee, a right-of-
<br />way for purposes of laying, constructing, operating, inspecting, maintaining, repairing, replacing,
<br />substituting, relocating and removing a storm sewer line on, in, over and through the following
<br />described land located in Hall County, Nebraska:

<br />A permanent easement:

<br />The East twenty (20) feet ofthe west forty-seven and one hal f (47.5) feet of Lot Eight
<br />(8), Block Two (2), Rief Addition in the Village of Doniphan, and the east twenty
<br />(20) feet of a tract ofland located in the Northwest Quarter ofthe Northeast Quarter
<br />(NWl/4NEl/4) Section 8, Township 9 North, Range Nine (9) West ofthe 6th P.M.,
<br />Hall County, Nebraska said tract of land described as follows: Commencing at a
<br />point on the north line of Section 8, Township 9 North, Range 9 West ofthe 6th P.M.,
<br />Three Hundred Sixty-three and one-half(363.5) feet east ofthe point of intersection
<br />ofthe east line ofthe St. Joseph and Grand Island Railway Company's right-of-way
<br />with said north line, running thence South and parallel with said right-of-way line
<br />Two Hundred Fifty-three (253) feet, thence East at right angles and parallel with
<br />said north line Seventy-four (74) feet, thence North at right angles Two Hundred
<br />Fifty-three (253) feet to the north line of said Section; thence west along said north
<br />line Seventy-four (74) feet to the Place of Beginning, of which the north Thirty-three
<br />(33) feet thereof is presently being used as a public road.

<br />land located in the Northwest Quarter of the Northeast Quarter (NWl/4NE1I4) of
<br />Section R, Township 9 North;-Range 9 West ofthe 6th P.M."Hall c:ounty, Nebrask~,
<br />said tract ofland described as follows: Commencing at a point on the north line of
<br />Section 9, Township 9 North, Range 9 West of the 6th P.M., Three Hundred Sixty-
<br />three and onc-half(363.5) feet east ofthe point ofinterscction ofthe east line of the
<br />St. Joseph and Grand Island Railway Company's right-of-way with said north line,
<br />running thence South and parallel with said right-of-way line Two Hundred Fifty-
