<br />200807402 <br /> <br />b. A Unit Owner may transfer any or all of its rights to use the Unit. Under no <br />circumstances, however, shall the Unit Owner be relieved of its responsibilities as a <br />Unit Owner hereunder. <br /> <br />11. Use of Common Elements. <br /> <br />a. Each Unit Owner may use the Common Elements in accordance with the purposes <br />for which they are intended, so long as such use does not hinder or encroach upon the <br />lawful rights of other Unit Owners nor violate the Condominium Documents. The <br />Board may adopt and amend from time to time rules and regulations governing the <br />use of Common Elements ("Rules and Regulations"), provided that such Rules and <br />Regulations are not in conflict with the Declaration and are uniform and <br />nondiscriminatory. Each Unit Owner, by the acceptance of a deed or other <br />instrument of conveyance or assignment, agrees to be bound by all such Rules and <br />Regulations. Copies of such Rules and Regulations as amended shall be furnished by <br />the Association to all Unit Owners and occupants ofthe Condominium upon written <br />request. <br /> <br />b. In addition to the rights of use herein described and elsewhere described in this <br />Declaration, the Association, the Board, managing agent, employees and independent <br />contractors shall have an unrestricted, irrevocable easement to traverse, cross, and <br />utilize any portion of the Common Elements which may be necessary in order to <br />install, maintain, repair, or replace any Cornmon Elements. <br /> <br />c. Each Unit Owner shall have a nonexclusive right in common with all of the other <br />Unit Owners to the use of all Cornmon Elements located within the entire <br />Condominium, if any. <br /> <br />d. No immoral, improper, offensive or unlawful use shall be made of any Unit nor any <br />part thereof; and all valid laws, zoning ordinances and regulations of all <br />governmental bodies having jurisdiction shall be observed. The responsibility of <br />meeting the requirements of governmental bodies for maintenance, modification or <br />repair of the Condominium shall be the same as the responsibility for the <br />maintenance, modification or repair of the property concerned. <br /> <br />12. Limited Common Elements. For purposes of describing the "Limited CornmonElements" of <br />the Condominium, the provisions of the Act, including Neb. Rev. Stat. ~ 76-839, shall apply <br />except as follows: <br /> <br />a. In addition to those Limited Cornmon Elements which may otherwise be created <br />hereunder, the Plats and Plans further describe Limited Cornmon Elements allocated <br />to the Units. The Limited Common Elements are designated in the Plats and Plans <br />by "LCE" followed by a reference to the Units to which the Limited Common <br />Elements are allocated. <br /> <br />-5- <br />
