<br />200807402 <br /> <br />the Condominium which are not inspected, maintained, and repaired <br />by the supplier of such service or any other entity. <br /> <br />iii. Notwithstanding the above, the Association reserves the right to hire one or <br />more persons or entities, including a managing agent, contractors, and <br />employees, to perform such services. <br /> <br />20. Compliance with Provisions of the Condominium Documents. <br /> <br />a. Each Unit Owner by acceptance of its deed or other instrument of conveyance or <br />assignment, and each tenant, agent, employee, and invitee by entry upon the <br />Condominium, agrees to comply strictly with the provisions of the Condominium <br />Documents, and the decisions and resolutions of the Board adopted pursuant thereto, <br />as the same may be lawfully amended from time to time. The Board, or in a proper <br />case, an aggrieved Unit Owner, shall have the power to enforce the provisions ofthe <br />Condominium Documents, and the decisions and resolutions ofthe Board pursuant <br />thereto. The Board shall take such action as it deems necessary or desirable to cause <br />such compliance by each Unit Owner and its tenants, agents, employees, and <br />invitees. Without limiting the generality of the foregoing, the Board shall have the <br />power to enforce the provisions of the Condominium Documents, and the decisions <br />and resolutions of the Board pursuant thereto, by anyone or more of the following <br />means: <br /> <br />1. by commencing and maintaining actions to restrain and enjoin any breach or <br />threatened breach of the provisions of the Condominium Documents, or <br />decisions and resolutions of the Board, by permanent injunction or otherwise; <br /> <br />11. by commencing and maintaining actions to recover damages for breach of <br />any of the provisions of the Condominium Documents, or decisions and <br />resolutions of the Board; and <br /> <br />111. by levying and collecting from any Unit Owner or its tenants, agents, <br />employees, or invitees, after notice and hearing as provided in the Bylaws, <br />reasonable and uniformly applied nondiscriminatory fines, penalties and <br />assessments established in advance in the Bylaws or in the Rules and <br />Regulations ofthe Association for breach of the Condominium Documents, <br />or decisions and resolutions ofthe Board, by such Unit Owner or its tenants, <br />agents, employees, or invitees. <br /> <br />b. All attorneys' fees and other costs of enforcing the Condominium Documents, or <br />decisions and resolutions of the Board, incurred by the Association, or in a proper <br />case by an aggrieved Unit Owner, shall be assessed against the Unit Owner found to <br />be in violation, and such assessment shall become a lien against such Unit Owner's <br />Unit and shall be enforced and collected in the same manner as all other Assessments <br />provided for herein. <br /> <br />-10- <br />
