<br />" <br />o.t <br /> <br />200806165 <br /> <br />Section Nineteen (19),Township Nine (9) North, Range Eleven (11), <br />West of the 6th P.M., in Hall County, Nebraska, together with any <br />accretion ground thereto. <br /> <br />(all of such real estate being hereinafter collectively referred to as "the WSW Land"); <br />and <br /> <br />WHEREAS, a portion of the Leaman Land is located to the north of the WSW <br />Land; and <br />WHEREAS, Darrel Gloe and Sharon Gloe, Husband and Wife, and Randall <br />Alexander, Trustee, as the parties plaintiff, have commenced an action in the District <br />Court of Hall County, Nebraska, bearing Case No. CI 06-832, wherein Leamans, WSW <br />and others are named parties defendant (such action being hereinafter referred to as <br />"the Boundary Line Suit"); and <br />WHEREAS, Leamans, on September 8, 2006, filed an Amended Answer, <br />Counterclaim and Cross-Claim in the Boundary Line Suit, and in the counterclaim and <br />cross-claim contained therein seek, among other things, to have the South boundary of <br />the Leaman Land determined; and <br />WHEREAS, WSW takes no position as to the specific location of the South <br />boundary line of the Leaman Land, except to the extent that such boundary line, or any <br />portion thereof, is one and the same as some part of the North boundary line of the <br />WBW Land; and <br />WHEREAS, a question has arisen between Leamans, on one hand, and WSW <br />on the other hand, as to the location of the North boundary line of the WBW Land; and <br />WHEREAS, Leamans and WSW have resolved and settled the question as to <br />the location of the North boundary line of the WSW Land, and desire to reduce their <br />resolution and settlement to writing. <br />
