UTILITY EASEMENT X004147 <br />ORVILLE W. CUMMING and PATRICIA A. CUMMING, husband and <br />wife, herein called the Grantors, in consideration of Fifty and <br />no/100 Dollars 50.00 receipt of which is hereby acknowledged, <br />t <br />hereby grant and convey unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation in Hall County, Nebraska, herein called <br />the Grantee, a permanent and perpetual easement and right -of -way <br />to construct, operate, maintain, repair, replace, and remove an <br />underground dewatering well and other appurtenances necessary for <br />dewatering well operation and maintenance upon, in, and through a <br />part of the Northwest Quarter of the Southwest Quarter (NW 1/4 SW <br />1/4), Section Eleven (11), Township Eleven (11) North, Range Ten <br />(10) West of the Sixth P.M., Hall County, Nebraska, more <br />particularly described as follows: <br />Beginning at a point on the South line of Lot Twelve <br />(12), Western Heights Subdivision, said point being <br />twenty (20) feet West of the Southeast corner of said <br />Lot Twelve (12); thence southerly perpendicular to said <br />South line of Lot Twelve (12) for a distance of twenty <br />(20) feet; thence westerly on a line twenty (20) feet <br />South of and Parallel to the said South line of Lot <br />Twelve (12) for a distance of five (5) feet; thence <br />northerly on a line for a distance of twenty (20) feet <br />to a point on the South line of said Lot Twelve (12), <br />being twenty -five (25) feet West of the Southeast <br />corner of said Lot Twelve (12); thence easterly on the <br />South .line of said Lot Twelve (12) for a distance of <br />five (5) feet to the point of beginning, and contain- <br />ing one hundred (100) square feet, more or less, all as <br />shown on the Plat marked Exhibit "A" attached hereto <br />and incorporated herein by reference, <br />together with the following rights, namely, unrestricted ingress <br />and egress under and across such land for the purpose of exercis- <br />ing the rights herein granted, to clear and keep clear of trees, <br />roots, brush, and other obstructions from the surface of such <br />tract. Any such underground dewatering well and appurtenances <br />placed upon and under such tract of land shall remain the <br />property of the Grantee and may be removed or replaced at. any <br />time. <br />L <br />14 <br />
