Assignment of Rents and Annointment of Receiver: Tenant hereby assigns to Landlord all of the rents, issues, and profits derived from the Demised Premises as security for performance of Tenant's obligations hereunder, provided that Tenant shall retain the right to collect and keep said rents, issues and profits as long as Tenant is not in default hereunder, as defined in Paragraph 23, above. If Tenant is in default under this Lease, Landlord shall have the right, in person or b receiver duly appointed by a court of competent jurisdiction, to take possession of the Demised Premises, including all replacement personal property located thereon owned by Tenant and used in the operation of the facility and to operate the facility and conduct the business of said facility collecting all rents, issues and profits due thereon to Tenant prior to and after the date of said default. In addition, if Tenant's default continues, neither the filing of a petition for the appointment of a receiver nor the appointment itself shall constitute an election by landlord to terminate this Lease. 30. No Waiver: No waiver by Landlord of any breach of the covenants, conditions or agreements of this Lease shall be construed to be a waiver of any succeeding breach of the same or of any other covenants, condition or agreement hereof. 31. Remedies Cumulative: The remedies conferred by this Lease upon Landlord are not intended to be exclusive, but are cumulative and in addition to all other remedies provided by law. 32. Tenant's Personal. Propertv: Tenant, at its own expense, may install and maintain such of its own personal property and equipment, in addition to the personal property and equipment listed in Exhibit "B" attached hereto and replacements thereof, as it may determine to be reasonably required to enable it to conduct its business in the Demised Premises in a good and businesslike manner. If Tenant is in default hereunder at any time during the term of this Lease, Landlord shall have a lien on Tenant's own personal property and equipment as long as such default continues. 33. Sians: 33.1 Tenant may erect only such sign or signs at or upon the Demised Premises as are approved by Landlord, which approval shall not be unreasonably withheld, and Tenant shall keep the same in presentable condition and repair and shall, the election of Landlord, remove the at same upon the expiration or prior termination of the term of this Lease, and repair any damage caused by such removal. -13- in 9 U
