85_.002916 <br />29. Assignment of Rents and Annointment of Receiver: <br />Tenant hereby assigns to Landlord all of the rents, issues, and <br />profits derived from the Demised Premises as security for <br />performance of Tenant's obligations hereunder, provided that <br />Tenant shall retain the right to collect and keep said rents, <br />issues and profits as long as Tenant is not in default hereunder, <br />as defined in Paragraph 23, above. If Tenant is in default under <br />this Lease, Landlord shall have the right, in person or b <br />receiver duly appointed by a court of competent jurisdiction, to <br />take possession of the Demised Premises, including all <br />replacement personal property located thereon owned by Tenant and <br />used in the operation of the facility and to operate the facility <br />and conduct the business of said facility collecting all rents, <br />issues and profits due thereon to Tenant prior to and after the <br />date of said default. In addition, if Tenant's default <br />continues, neither the filing of a petition for the appointment <br />of a receiver nor the appointment itself shall constitute an <br />election by landlord to terminate this Lease. <br />30. No Waiver: No waiver by Landlord of any breach of <br />the covenants, conditions or agreements of this Lease shall be <br />construed to be a waiver of any succeeding breach of the same or <br />of any other covenants, condition or agreement hereof. <br />31. Remedies Cumulative: The remedies conferred by <br />this Lease upon Landlord are not intended to be exclusive, but <br />are cumulative and in addition to all other remedies provided by <br />law. <br />32. Tenant's Personal. Propertv: Tenant, at its own <br />expense, may install and maintain such of its own personal <br />property and equipment, in addition to the personal property and <br />equipment listed in Exhibit "B" attached hereto and replacements <br />thereof, as it may determine to be reasonably required to enable <br />it to conduct its business in the Demised Premises in a good and <br />businesslike manner. If Tenant is in default hereunder at any <br />time during the term of this Lease, Landlord shall have a lien on <br />Tenant's own personal property and equipment as long as such <br />default continues. <br />33. Sians: <br />33.1 Tenant may erect only such sign or signs at <br />or upon the Demised Premises as are approved by Landlord, which <br />approval shall not be unreasonably withheld, and Tenant shall <br />keep the same in presentable condition and repair and shall, <br />the election of Landlord, remove the at <br />same upon the expiration or <br />prior termination of the term of this Lease, and repair any <br />damage caused by such removal. <br />-13- <br />in <br />9 <br />U <br />
