If, however, Tenant shall abandon or vacate the Demised Premises, or be dispossessed thereof by process of law, or otherwise, in addition to all other rights Landlord may have hereunder or at law, any personal property belonging to Tenant and located in the Demised Premises shall, at the election of Landlord, become the property of Landlord, subject, however, to the rights, if any, of any mortgagee(s) under any mortgage(s) against the Demised Premises. 23. Events of Default: 23.1 The occurrence of any of the following shall be deemed to constitute an event of default on the part of Tenant hereunder: 23.1.1 The failure to pay rent, real or personal property taxes and assessments, utilities, or premiums for insurance when the same are due; 23.1.2 The failure to perform or comply with any other term or provision of this Lease; 23.1.3 An assignment by Tenant of its property for the benefit of creditors; 23.1.4 The appointment of a receiver, trustee or liquidator for Tenant, or any of the property of Tenant, if such receiver, trustee or liquidator is not discharged within sixty (60) days after the date of its appointment; against this Lease; 23.1.5 The levy of a writ of attachment 23.1.6 The balance sheets for Tenant and for L. Dean Beebe provided to Landlord by Tenant prior to the execu- tion of this Lease are determined to be intentionally false or misleading. 23.2 In the event of the occurrence of any event of default mentioned in this Paragraph 23, Landlord shall have the right, at its election, by written notice to Tenant, in addition to all other remedies, to terminate this Lease. 24. Landlord's Recovery From Tenant: 24.1 Upon termination of this Lease by Landlord under and in accordance with the provisions of Paragraph 23, above, Landlord shall be entitici to recover from Tenant the following: OHM L 9
