If, however, Tenant shall abandon or vacate <br />the Demised Premises, or be dispossessed thereof by process of <br />law, or otherwise, in addition to all other rights Landlord may <br />have hereunder or at law, any personal property belonging to <br />Tenant and located in the Demised Premises shall, at the election <br />of Landlord, become the property of Landlord, subject, however, <br />to the rights, if any, of any mortgagee(s) under any mortgage(s) <br />against the Demised Premises. <br />23. Events of Default: <br />23.1 The occurrence of any of the following shall <br />be deemed to constitute an event of default on the part of Tenant <br />hereunder: <br />23.1.1 The failure to pay rent, real or <br />personal property taxes and assessments, utilities, or premiums <br />for insurance when the same are due; <br />23.1.2 The failure to perform or comply with <br />any other term or provision of this Lease; <br />23.1.3 An assignment by Tenant of its <br />property for the benefit of creditors; <br />23.1.4 The appointment of a receiver, trustee <br />or liquidator for Tenant, or any of the property of Tenant, if <br />such receiver, trustee or liquidator is not discharged within <br />sixty (60) days after the date of its appointment; <br />against this Lease; 23.1.5 The levy of a writ of attachment <br />23.1.6 The balance sheets for Tenant and for <br />L. Dean Beebe provided to Landlord by Tenant prior to the execu- <br />tion of this Lease are determined to be intentionally false or <br />misleading. <br />23.2 In the event of the occurrence of any event <br />of default mentioned in this Paragraph 23, Landlord shall have <br />the right, at its election, by written notice to Tenant, in <br />addition to all other remedies, to terminate this Lease. <br />24. Landlord's Recovery From Tenant: <br />24.1 Upon termination of this Lease by Landlord <br />under and in accordance with the provisions of Paragraph 23, <br />above, Landlord shall be entitici to recover from Tenant the <br />following: <br />OHM <br />L <br />9 <br />
