k <br />`t <br />s <br />f <br />85-- .002916 <br />the escrow holder to release funds only upon proof <br />and /or receipt of lien waivers for all 1 borand mater materials. <br />10.2 Protection Against Lien Claims: Tenant <br />agrees to fully pay and discharge all claims for labor and <br />materials furnished in connection with the reconstruction, <br />remodeling or alteration of the Demised Premises, to obtain lien <br />releases for labor or materials for which payment has been made, <br />and to-take all other reasonable steps to forestall the assertion <br />of lien claims against the Demised Premises. <br />10.3 Compliance with Law: All work done in <br />connection with reconstruction, remodeling or alteration of the <br />Demised Premises shall be performed in compliance with all <br />applicable laws, ordinances, rules and regulations. <br />10.4 Compliance with Deed(s) of Trust: The <br />reconstruction, remodeling or alteration of the Demised Premises <br />shall be performed in compliance with any deed(s) of trust <br />against the Demised Premises. <br />10.5 Governmental Permits and Consents: No <br />reconstruction, remodeling or alteration of the Demised Premises <br />shall be effected unless and until Tenant has obtained all <br />required permits and consents from all governmental entities or <br />agencies having jurisdiction over the Demised Premises. <br />10.6 Title to Alterations: All alterations and <br />improvements constructed by Tenant upon the Demised Premises <br />shall, upon termination of this Lease, belong to Landlord. <br />10.7 Hold Harmless: Tenant shall save and hold <br />Landlord and any mortgagee(s) under any mortgage(s) against the <br />Demised Premises harmless from any and all liability of any kind <br />on account of the reconstruction, remodeling or alteration of the <br />Demised Premises. <br />11. Riaht to Replace Prooertv: Notwithstanding any <br />other provision of this Lease to the contrary, Tenant shall have <br />the right, subject to the provisions of any mortgage(s) against <br />the Demised Premises, to replace any or all of the personal <br />property, fixtures, equipment and supplies listed in Exhibit "B" <br />attached hereto, with personal property, machinery, fixtures, <br />equipment or supplies of like or greater value, which shall <br />automatically become the property of Landlord and thereafter <br />subject to this Lease. The discarded, obsolete, or dilapidated <br />personal property, machinery, fixtures, equipment and supplies <br />that has or have been replaced by Tenant shall become the <br />property of Tenant. <br />-7- <br />a <br />
